Interim Provisions of Beijing Municipality on Inspection and Reporting System of Cultural Relics Protection Units (revised on 20 10)
Article 1 In order to strengthen the regular protection and management of cultural relics protection units in this Municipality, and timely discover and deal with illegal acts, these Provisions are formulated in accordance with the Law of People's Republic of China (PRC) Municipality on the Protection of Cultural Relics and the Measures of Beijing Municipality for Implementing the Law of People's Republic of China (PRC) Municipality on the Protection of Cultural Relics. Article 2 National key cultural relics protection units, municipal cultural relics protection units and district and county cultural relics protection units (hereinafter referred to as cultural relics protection units) within the administrative area of this Municipality must implement the inspection and reporting system in accordance with these regulations. Article 3 The daily patrol inspection of cultural relics protection units shall be undertaken by the management and use units of cultural relics protection units (hereinafter referred to as management and use units); If there is no management and use unit, the institutions or personnel designated by the municipal, district and county cultural relics administrative organs shall be responsible.

Gardens, religions, housing management and education departments should urge the management and use units of this system to do a good job in patrol inspection. Article 4 The patrol duties of management and use units are:

(a) to check the preservation and use of cultural relics buildings and their affiliated cultural relics (including cultural relics kept and displayed by them); Check the protection scope of cultural relics protection units in the construction control zone (hereinafter referred to as the protection scope and control zone) and the protection status of the original pattern, environmental landscape and style of cultural relics buildings.

(two) to stop the destruction of cultural relics buildings and their affiliated cultural relics; Stop the destruction of the original pattern, environmental landscape and style of cultural relics buildings within the scope of protection and control zone; Stop illegal activities such as moving, dismantling, defacing and destroying cultural relics protection signs without authorization.

(three) found that the cultural relics buildings and affiliated cultural relics have natural damage or hidden dangers of natural damage, and take corresponding protective measures in time.

The management and use unit shall regularly report the inspection to the local cultural relics management authority; If illegal acts and cultural relics are found, they shall report to the cultural relics administration authorities in a timely manner. Article 5 The Municipal Bureau of Cultural Relics shall, in a planned way every year, organize key inspections of cultural relics protection units at all levels in this Municipality, and supervise, manage and use the units to keep and use cultural relics.

National key cultural relics protection units shall be inspected once every six months by the Municipal Bureau of Cultural Relics.

Municipal cultural relics protection units shall be inspected once every six months by the district and county cultural relics administrative organs, and the Municipal Bureau of Cultural Relics shall conduct key spot checks.

District and county-level cultural relics protection units shall be inspected by the district and county cultural relics administrative organs in a planned way every year. The inspection results of the cultural relics administrative organ shall be reported to the people's government at the same level and the cultural relics administrative organ at a higher level for the record. Article 6 The staff of the cultural relics administrative organ shall produce special inspection certificates when conducting patrol inspection and supervising and managing the use of cultural relics protection units, and the units under supervision and inspection shall actively cooperate with them and shall not obstruct them. Seventh cultural relics administrative organs at all levels shall publish the telephone number and mailing address of the report in the cultural relics protection units to facilitate the supervision of the masses. Article 8 Those who have made outstanding achievements or contributions to the implementation of the patrol inspection system and the protection of cultural relics shall be commended and rewarded by the Municipal Bureau of Cultural Relics.

Those who fail to implement the patrol inspection system as required shall be punished by the cultural relics administrative organ in accordance with relevant laws and regulations.

If the cultural relics administrative organ and its staff seriously neglect their duties, resulting in great consequences of cultural relics damage, the administrative responsibility of the person directly responsible and the person in charge shall be investigated by the higher authorities. Article 9 The Municipal Bureau of Cultural Heritage shall be responsible for organizing and supervising the implementation of these Provisions. Article 10 These Provisions shall come into force as of the date of promulgation with the approval of the Municipal People's Government.
