Regulations of Nanchang Municipality on the Administration of Bus and Tram Passenger Transport
Chapter I General Provisions Article 1 In order to strengthen the passenger transport management of urban buses and trams (hereinafter referred to as buses and trams), maintain the passenger transport order of buses and trams, and protect the legitimate rights and interests of passengers and operators, these Regulations are formulated in accordance with the provisions of relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 The term "buses and trams" as mentioned in these Regulations refers to passenger vehicles that run for public use according to the prescribed routes, stations and time.

The passenger service facilities mentioned in these Regulations refer to parking lots, station houses, bus shelters, platforms, stop signs and power supply and distribution facilities. Article 3 Units and individuals engaged in the operation and management of buses and trams, the construction and maintenance of passenger service facilities and the carrying of passengers within the urban planning area of this Municipality shall abide by these regulations. Article 4 The municipal public utilities administrative department is the administrative department in charge of bus and tram passenger transport in this Municipality, and its subordinate municipal passenger transport management institutions are responsible for daily management.

City planning, public security, municipal administration, industry and commerce, price, transportation, tourism and other administrative departments shall, in accordance with their respective responsibilities, do a good job in the management of bus and tram passenger transport. Article 5 The management of bus and tram passenger transport shall follow the principles of overall planning, unified management, fair competition, standardized operation and convenience for the masses.

The Municipal People's Government shall give priority to the development of bus and tram passenger transport, and encourage the application of advanced science and technology and management methods in the management and operation of bus and tram passenger transport. Chapter II Planning and Construction Article 6 The municipal public utilities management department shall, according to the overall urban planning, formulate a development plan for bus and tram passenger transport, which shall be implemented after being reviewed by the municipal planning management department and approved by the municipal people's government. Article 7 The municipal administrative department of public utilities shall, jointly with relevant departments, formulate the bus and tram passenger transport network planning and passenger transport service facilities construction planning according to the bus and tram passenger transport development planning, and organize the implementation after being reported to the Municipal People's Government for approval.

The municipal public utilities administrative department shall, according to the bus and tram passenger transport development planning, bus and tram passenger transport network planning and passenger service facilities construction planning, prepare the bus and tram passenger transport construction planning and incorporate it into the national economic and social development plan. Article 8 The land for bus and tram passenger service facilities determined in the overall urban planning and bus and tram passenger development planning shall be reserved by the municipal planning administrative department in accordance with the planning, and no unit or individual may occupy or change its nature of use. Ninth new construction, renovation and expansion of urban roads, should be based on the bus and tram passenger network and passenger service facilities construction planning to set up a harbor-style waiting station and departure station.

Conditional urban trunk roads should be equipped with bus and tram lanes to ensure that buses and trams have priority. Article 10 When planning and constructing new urban areas, old urban areas, residential areas, airports, railway stations, long-distance bus stations, docks, large commercial centers, large cultural and entertainment venues, tourist attractions and stadiums, bus and tram stops and corresponding parking lots shall be constructed according to the bus and tram passenger transport development plan, and shall be designed, constructed and accepted synchronously with the main project. Eleventh bus tram passenger service facilities construction project design and construction, should strictly implement the relevant provisions of the state and technical standards. When designing the scheme, the construction unit shall solicit the opinions of the municipal administrative department of public utilities.

After the completion of the bus and tram passenger service facilities construction project, the municipal public utilities administrative department shall participate in the acceptance. Only after the acceptance is qualified can it be delivered for use. Twelfth bus and tram passenger lines and stations shall be set up and adjusted in accordance with the requirements of bus and tram passenger line network planning, so as to facilitate passengers to ride and transfer.

The setting and adjustment of bus and tram passenger lines and stations shall be approved by the public security traffic management institution and implemented after being approved by the municipal public utility administrative department. No unit or individual may change or cancel the bus and tram passenger lines without authorization. Thirteenth bus and tram passenger transport operators shall set up stop signs at bus and tram stations in accordance with the unified style stipulated by the municipal administrative department of public utilities.

Bus and tram stop signs shall indicate the name of the line, the time of the first and last bus, the name of the station and the stops along the way. Chapter III Management of Line Operation Rights Article 14 The Municipal People's Government shall implement the line franchise management system for bus and tram passenger lines. The measures for the administration of line franchise shall be formulated by the Municipal People's Government in accordance with the relevant provisions of the state, province and this Ordinance. The daily management is the responsibility of the administrative department of municipal public utilities. Fifteenth Municipal People's Government may determine the operators who specialize in bus and tram passenger lines by means of bidding, application and entrustment. Sixteenth who bid for or apply to engage in bus and tram passenger transport business, must meet the following conditions:

(a) a city public passenger transport enterprise qualification certificate;

(2) It has funds suitable for its business scale;

(3) There is a certificate of purchase of passenger vehicles or a corresponding number of vehicles that meet the prescribed requirements;

(4) Having corresponding parking lots and supporting facilities;

(5) Having corresponding managers, drivers, flight attendants and dispatchers who have passed the vocational training;

(six) a sound passenger service, passenger safety, vehicle warranty and other management systems and management institutions.
