The two websites in Yanji downloaded Korean music and movies from the Internet without legal authorization for their own website members to download and use in order to make a profit. Due to suspected copyright infringement, these two websites were sealed and the responsible persons were transferred to judicial authorities for processing. Yesterday, the relevant persons in charge of the National Copyright Administration and the Provincial Copyright Administration organized the media to go to Yanji to interview the matter.
Received a complaint and filed an investigation
On July 28 this year, entrusted by the Korean Music Copyright Association, the China Music Copyright Association complained to the National Copyright Administration and the Yanji Municipal Cultural Bureau, saying that they passed Long-term tracking and monitoring of the download traffic of domestic music websites found that two websites with IP addresses of Yanji City and domain names of www.imdj.net and www.imdj.net provide a large number of Korean music works for users to listen to and download for free, seriously infringing the relevant authors. copyright, causing strong dissatisfaction from the copyright owner. The Copyright Department of the National Copyright Administration transferred the case to the Jilin Provincial Copyright Administration and requested that the case be filed and investigated seriously.
The Provincial Copyright Bureau attaches great importance to this case. Director Li Chang of the Copyright Division led law enforcement officers and public security department personnel to investigate and deal with the case together with the copyright management departments of Yanbian Prefecture and Yanji City, and listed the case as It is the number one case this year in the special governance action against online infringement and piracy.
Quickly dispatch the person in charge of control
Law enforcement officers took screenshots of the web pages of the two websites, obtained evidence of infringement of the two websites, and also obtained the office address of the person responsible for the website.
On October 15, the Provincial Copyright Administration and the copyright management departments of Yanbian Prefecture and Yanji City, with the cooperation of the network management department of the Yanji Municipal Public Security Bureau, set up a task force to investigate the case. At about 14:00 that day, the task force divided into two groups and cut off the website server along the way to prevent infringers from remotely deleting the infringing content or taking away the server. We rushed all the way to the office of the person in charge of the website to control the personnel.
In this operation, 5 imdj website servers, 3 o2sky website servers, and 8 computer hosts were seized on the spot. Park, the person in charge of the o2sky website, was controlled on the spot, and Li, the person in charge of the imdj website, absconded in fear of crime and was found by law enforcement officers shortly after.
Develop members and make website profits
According to law enforcement officials, the o2sky website was established and started operating in November 2006. Park said that the website started with free listening and viewing of Chinese, Korean, and Japanese music and movies. When the website's click-through rate increased to a certain level, it began to charge for membership. Some of the music and movies on the website are downloaded from Korean websites, and some are downloaded from domestic websites. At the time of the incident, the website had 400,000 members, with a monthly income of around 20,000 yuan, and a cumulative illegal business income of 700,000 yuan.
Li, the person in charge of the imdj website, told law enforcement officials that he was not the legal representative of the website, but a partner. The legal representative of the website, Li Moumou, is now in Beijing. There are movies and music downloaded from Korean websites on the website, and they also charge for search links for Google. In addition to the above, Li refused to explain the amount of profit and did not provide the server password, making it impossible for law enforcement officers to obtain further evidence.
The case was transferred to the judicial authorities
Yesterday, at the Yanji Municipal Cultural Bureau, the persons in charge of the two websites, Park and Li, were interviewed by reporters. Both of them said they had no idea it was illegal to build such a website. "Nowadays, many websites offer free downloads. After watching others download, we downloaded and built websites. Unexpectedly, this was also illegal." "If we are breaking the law, others are also doing this, but they have not been punished. Check, we really don’t understand.” Facing reporters, the two still did not realize that their behavior was a serious infringement crime.
Law enforcement officials said that through the current investigation and evidence collection of the two infringing websites, it can be proved that the infringement behavior of these two websites is established. In accordance with my country's Copyright Law and other relevant regulations, on October 28, law enforcement officials officially transferred the online infringement cases of these two websites to judicial authorities to investigate the criminal liability of the parties involved.
It is understood that two websites suspected of copyright infringement have been sealed.
