The punishment standard for the crime of smuggling is in Article 153 of the Criminal Law. Whoever smuggles and evades taxes is especially serious or has other particularly serious circumstances shall be sentenced to fixed-term imprisonment of not less than 10 years or fixed-term imprisonment, and shall also be fined not less than one time but not more than five times of tax evasion or confiscation of illegal income. If an enterprise commits the crime mentioned in the preceding paragraph, it shall be fined, and the directly responsible management personnel and other directly responsible personnel shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention; If the circumstances are bad, they shall be sentenced to fixed-term imprisonment of not less than three years but not more than 10 years, and if the circumstances are especially serious, they shall be sentenced to fixed-term imprisonment of not less than 10 years. If several smuggled goods are unresolved, they shall be punished for tax evasion according to smuggled goods and articles.
