Measures of Beijing Municipality on Implementing the Law of People's Republic of China (PRC) Municipality on the Protection of Cultural Relics
Article 1 In order to strengthen the protection of cultural relics, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) Municipality on the Protection of Cultural Relics and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the protection of cultural relics within the administrative area of this Municipality. Article 3 The municipal, district and county people's governments shall be responsible for the protection of cultural relics within their respective administrative areas.

The administrative departments of cultural relics of the municipal, district and county people's governments shall supervise and manage the protection of cultural relics within their respective administrative areas.

The relevant administrative departments of planning, construction, gardening, land and resources, industry and commerce, public security, development and reform, tourism, religion and so on shall do a good job in the protection of cultural relics according to law within their respective functions and duties. Article 4 The municipal, district and county people's governments shall incorporate the cause of cultural relics protection into the national economic and social development plan at the corresponding level, and the required funds shall be included in the fiscal budget at the corresponding level. The city's financial allocation for cultural relics protection increases with the growth of fiscal revenue.

The municipal, district and county people's governments shall set up special funds for cultural relics protection according to the actual needs of cultural relics protection within their respective administrative areas.

This Municipality encourages natural persons, legal persons and other organizations to donate to the cause of cultural relics protection. Donations accepted by the Municipal Cultural Relics Protection Foundation, cultural relics protection units and other recipients shall be used exclusively for cultural relics protection, and no unit or individual may occupy or misappropriate them. Article 5 This Municipality encourages and supports scientific and technological research on the protection of cultural relics.

The municipal administrative department of cultural relics shall formulate a scientific and technological research plan for cultural relics protection, promote the popularization and application of scientific and technological achievements in cultural relics protection, and improve the scientific and technological level of cultural relics protection.

The municipal, district and county cultural relics administrative departments are responsible for organizing the training of cultural relics and museum professionals. Article 6 A general survey system of cultural relics shall be established in this Municipality. The Municipal People's Government regularly organizes cultural relics surveys, and the district and county people's governments are responsible for regularly conducting general surveys and registration of immovable cultural relics within their respective administrative areas, and filing with the municipal cultural relics administrative department. Seventh district and county people's governments shall establish archives for immovable cultural relics that have not been approved as cultural relics protection units within their respective administrative areas; Regularly identify its historical, artistic and scientific value, and according to the identification results, those approved as district or county-level cultural relics protection units shall be published once every three years. Article 8 The municipal administrative department of cultural relics shall be responsible for organizing the formulation of specific protection measures for cultural relics protection units at or above the municipal level, and promulgating their implementation.

The district and county cultural relics administrative departments are responsible for organizing the formulation of specific protection measures for district and county cultural relics protection units and immovable cultural relics that have not been approved as cultural relics protection units, and promulgating and implementing them.

Protection measures include the restoration, safety, utilization and environmental improvement of immovable cultural relics. Article 9 Managers and users of immovable cultural relics shall formulate plans for the maintenance of cultural relics and plans for the prevention and disposal of natural disasters and emergencies; According to the level of immovable cultural relics, cultural relics protection units at or above the municipal level shall report to the municipal cultural relics administrative department for the record, and cultural relics protection units at the district and county levels and immovable cultural relics not approved as cultural relics protection units shall report to the district and county cultural relics administrative departments for the record. If the protection plan or scheme is not formulated or not filed, the administrative department of cultural relics shall order it to make corrections. Article 10 After approval and promulgation, cultural relics protection units shall delimit the scope of protection and construction control zones according to law. District and county-level cultural relics protection units located in more than two administrative regions shall be jointly responsible by the relevant district and county people's governments for delineating their protection scope and building control zones; In case of disputes over the delineation of the scope of protection and the construction control zone, the district and county people's governments designated by the Municipal People's Government shall be responsible. Article 11 Where the scope of protection and construction control zones of two or more cultural relics protection units overlap with each other, the planning administrative department shall, when examining and approving the construction projects in this area, implement the stricter construction control standards. Twelfth construction site selection, should try to avoid immovable cultural relics. If it is unavoidable due to special circumstances, the cultural relics protection unit shall, as far as possible, implement in-situ protection; Unable to implement the original site protection, need to move protection or demolition, the construction unit shall report to the municipal administrative department of cultural relics, approved by the Municipal People's government; The relocation of national key cultural relics protection units shall be reported to the State Council by the Municipal People's Government for approval.

Where immovable cultural relics that have not been approved as cultural relics protection units are moved or dismantled, the construction unit shall report to the cultural relics administrative department of the district or county people's government for approval. The district and county people's governments shall obtain the consent of the municipal administrative department of cultural relics before approval. Thirteenth immovable cultural relics shall be repaired in accordance with the approved repair plan. If the repair plan is changed, the manager and user of immovable cultural relics shall report to the original approved cultural relics administrative department for re-approval.

The decoration of cultural relics buildings shall conform to the decoration standards of cultural relics buildings and shall not cause damage to cultural relics buildings. Decoration standards for cultural relics buildings shall be formulated by the municipal administrative department of cultural relics. Fourteenth managers and users of cultural relics buildings should strengthen the management of fire sources and power sources in accordance with regulations, and be equipped with necessary fire fighting equipment. According to the actual needs, install automatic alarm, fire fighting, lightning protection and other facilities in key parts. The installation and use of facilities shall not cause damage to cultural relics buildings.

In case of great danger endangering the safety of cultural relics, the managers and users of cultural relics buildings shall take timely measures and report to the district or county cultural relics administrative department where the building is located.
