The "standard work" mentioned in Article 3 of Several Provisions (Guo Fa [1982] No.62) generally refers to the level salary in the salary standard table formulated by the state, but the old cadres who retain their wages include the retained wages.

Veteran cadres enjoy "living allowance" according to "Several Provisions". No matter which month is approved for retirement from 1 month to1February, it will be paid in full once a year in the month when retirement is approved (the bonus received before retirement will not be deducted). Living allowance for retired veteran cadres should be paid from April 65438 to April 0982. From the second year, it will be distributed every year 1 month. (Lao Ren Lao [1982]No. 10)

L insurance and unified planning

The insurance benefits enjoyed by the immediate family members of retired cadres in state-owned enterprises include funeral subsidies, pension fees, relief funds and medical care. Among them, the medical expenses are the same as when retired cadres are on the job. After the employees of state-owned enterprises retire, their immediate family members no longer enjoy medical treatment. Retirees should enjoy the same funeral allowance as on-the-job employees after their death; If there are dependent immediate family members, their dependent immediate family members can also enjoy pension or relief funds. (No.[1986] 1).

After the State Council's decision on establishing a unified basic old-age insurance system for enterprise employees is implemented, employees who have joined the work and whose individual contribution period has reached 15 years will be paid a basic pension on a monthly basis after retirement. Basic pension consists of basic pension and personal account pension. When retiring, the monthly standard of basic pension is 20% of the average monthly salary of employees in provinces, autonomous regions, municipalities directly under the Central Government or prefectures (cities), and the monthly standard of personal account pension is the amount stored in my account divided by 120. If the individual payment period is less than 15 years, he will not enjoy the basic pension after retirement, and the amount stored in his personal account will be paid to him in one lump sum. Those who have retired before the implementation of the decision will still be given pensions according to the original provisions of the state, and the pension adjustment measures will be implemented at the same time. All regions and relevant departments should further improve the normal adjustment mechanism of basic pensions in accordance with state regulations and conscientiously implement them. If you decide to take part in the work before implementation, retire after implementation, and the cumulative payment and deemed payment period reach 15 years, the transitional pension will be determined on the basis of basic pension and personal account pension according to the principle of balanced connection between old and new methods and basically balanced treatment level, and the transitional pension will be solved from the endowment insurance fund. (Guo Fa [1997] No.26)

All localities should strengthen the collection and payment of basic old-age insurance premiums, financial subsidies and other measures to ensure that basic pensions are paid in full and on time. At present, areas that still pay the basic old-age insurance premiums in full should pay them in full before the end of September this year. All localities are not allowed to implement closed operation between industries,

In areas where the basic old-age insurance has not been fully implemented at the provincial level, while clearly ensuring the responsibility for payment, it is necessary to increase the intensity of fund adjustment. For areas that do have payment difficulties in the current period, it is necessary to implement fund adjustment in a timely manner. Carefully clean up the basic pension calculation and payment standards, and the basic pension in the overall planning project stipulated by the state must be guaranteed to be paid in full; Outside the overall project, it should be determined by the enterprise according to the benefits. Socialized payment of basic pension is an important means to ensure timely and full payment and reduce the burden on enterprises, and it is also a necessary condition to establish a social security system independent of enterprises. All localities should formulate work plans and implementation plans for socialized distribution of basic pensions, and strive to basically realize the goal of distributing basic pensions by social insurance agencies or social service agencies such as banks and post offices before the end of this year. (Guo Fa [2000] No.8)

L maintenance fee

Retired cadres who are disabled in the line of duty and need help in life can generally be given nursing fees that do not exceed the standard wage of second-class workers in the local general machinery industry. If you can't take care of yourself for a long time due to paralysis and other reasons, you can send nursing fees as appropriate. Disabled people who need to buy tools and those who have difficulties may be given subsidies as appropriate. (Guo Fa [1980] No.253)

"Interim Provisions" referred to in Article 5 of the sick and disabled nursing subsidy standards shall not exceed the local general machinery industry second-class wage standards. After the illness improves and life can basically take care of itself, the nursing subsidy will stop being paid. (Lao Ren Lao [1982]No. 10)

For special-grade and first-class disabled revolutionary servicemen who are disabled due to war injuries, completely lose their ability to work and need help in their daily lives, with reference to the relevant provisions of Guo Fa [1978] 104 and Guo Fa [1980]253, the units that issue retirement and resignation fees will issue nursing fees. (Min [ 1984] You 18)

The nursing expenses enjoyed by retirees who meet the requirements stipulated by the state shall be adjusted to the central line of the local new five-level standard wage (5 1985+0) stipulated in the Notice on Printing and Distributing the Wage Standards for Employees of Large and Medium-sized State-owned Enterprises. This notice shall be implemented as of the month of issuance (1986 1 1). (Lao Ren Lao [1986]No. 16)

According to the degree of complete, most and part of nursing dependence, the standard of nursing expenses for employees with work-related injuries and employees with total disability in enterprises is generally 50%, 40% and 30% of the average wage of local society respectively. The expenses shall be paid according to the current channels. All provinces, autonomous regions and municipalities directly under the Central Government may formulate specific standards in light of local actual conditions. The standard of nursing expenses can be higher than 50% of the average social wage for those who are completely dependent on nursing, and lower than 30% of the average social wage for those who are slightly dependent on nursing. (Laoxian Zi [1992] No.28)

Workers and retirees of state organs and institutions who are disabled on duty, completely incapacitated, unable to take care of themselves, and need help in their daily lives can pay a certain amount of nursing expenses appropriately. The standard of nursing expenses is determined according to the disability grade assessed by the Ministry of Civil Affairs' Conditions for Evaluating the Disability Grade of Revolutionary Disabled Soldiers (Min [1989]No. 18). Disabled people with special and first-class disabilities can enjoy nursing fees. The standard is: the special grade is 50% of the average wage of the local society; The first gear is 40% and 30% of the local average wage. If the disability is particularly serious, the nursing fee can be slightly higher than the standard of this level, and if the disability is lighter, the nursing fee can be slightly lower than the standard of this level. All provinces, autonomous regions and municipalities directly under the central government may formulate specific standards for nursing expenses in light of local actual conditions. (Rentuifa [1993]No. 1)

For retired cadres who cannot take care of themselves for a long time due to paralysis and other reasons, the standard of nursing expenses has been adjusted from the median line of the standard monthly salary of the new five-level local work (5 1 yuan in six districts) to 0/00 yuan per month. Areas exceeding this standard will not be adjusted. The new nursing fee standard was implemented from July 1998. (No.[1998]56)

After the death of the staff of state organs and institutions, the survivors have difficulties in living, and the unit where the deceased lived can give regular or temporary subsidies in accordance with the principle of "more subsidies for great difficulties and less subsidies for minor difficulties".

The subsidy standard for survivors' living difficulties is generally based on the principle of maintaining the lives of local people, and the specific standards are stipulated by provinces, municipalities and autonomous regions (the central state organs and institutions implement the standards in their respective regions). For those who died in the protection and rescue of state-owned assets or in the struggle against the enemy, the subsidy standard for survivors' living difficulties may be appropriately raised. (Min Fa [1980] No.5 Cai [1980] No.34)

With the approval of the State Council, it was decided to adjust the one-time pension standards for soldiers, state functionaries and immigrant militia who died in the line of duty. From 1 June 65438+July 9861,soldiers, state functionaries and immigrant militiamen who died in the line of duty were given lump-sum pensions according to the following standards: lump-sum pensions for military cadres, volunteers and state functionaries who died in the line of duty were paid according to their 20-month salary at the time of sacrifice. Pensions for military cadres, volunteers and functionaries who died of illness shall be calculated and paid according to their monthly salary at the time of death, but the maximum amount shall not exceed 3,000 yuan. Soldiers who were awarded the title of hero model by the Military Commission or the Military Region died in the line of duty or died, and should receive additional pension 1/3. Soldiers who have won the second class merit citation or above who die in the line of duty shall receive a pension of 1/4 and be issued with additional shares. The pension standards for retired soldiers and state functionaries who died in the line of duty are also implemented according to the above provisions (retirees are paid their full wages when they retire). (Min [1986] Post No.6)

After retirement 1993, 10, 1 days, the calculation base is the sum of the salary of the post (technical level) and the allowance calculated according to the proportion stipulated by the state. In the future, the retirement fee increased in accordance with state regulations will be included in the one-time death pension. The payment standard of one-time death pension is still implemented according to the existing regulations, that is, if it is approved as a revolutionary martyr, it will be 40 months' salary before his death; Those who died in the line of duty worked for 20 months before their death; If you die of illness, it is 10 month's salary. Cancel 1986' s stipulation that the maximum amount of one-time pension after death should not exceed 3,000 yuan (1994).

Medical treatment and health care

The medical treatment of retired personnel and the old Red Army remains unchanged, and the medical expenses are solved according to the original funding channels. Payment is indeed difficult, by the people's government at the same level to help solve. Measures for the medical management of retired personnel and the old Red Army shall be formulated by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.

Retirees participate in the basic medical insurance, and individuals do not pay the basic medical insurance premium. Appropriate care should be given to the amount included in the personal account of retirees and the proportion of medical expenses borne by individuals. (Guo Fa [1998] No.44)

Visit relatives

The purpose of establishing the system of visiting relatives for employees is to solve the problem of reunion of on-the-job employees separated from their families due to work and production needs. Retired and resigned employees have left their jobs and production posts, and there is a widespread problem of separation from their families. Family leave should not be understood as unproductive welfare treatment. Therefore, after retirement, employees should no longer enjoy the treatment of visiting relatives stipulated by the State Council. (The letter number is [1989] 1 of the Labor Protection Department)

I live in a house.

On the ownership of retired cadres' housing (excluding private houses). The original work unit and the resettlement unit have agreed on the ownership, which shall be determined in accordance with the agreement; If there is no clear ownership, according to the spirit of Article 14 of Lao Ren Lao [1982] 10, the property right belongs to the resettlement unit or region. In the process of housing reform, retired cadres who have been resettled need to purchase existing housing, they should go through the relevant procedures according to the policies and regulations of the property right holding unit or region, and enjoy the preferential treatment for the purchase of retired cadres at the same rank in the unit or region where they belong.
