According to the fourth category "distribution services" in Part II "Specific Commitments" of the MFN exemption list in Annex 9 of the Protocol of People's Republic of China (PRC)'s Accession, China lifted the restrictions on "establishing wholesale or retail service commercial institutions without fixed locations" in terms of market access and national treatment after 5438+February 1 June 2004. The so-called wholesale or retail service without a fixed location is international direct selling. It seems that the road of direct selling in China has never been smooth, from the early disorderly opening to the later disorderly prohibition, to the limited opening, until today's legislation. However, the advent of direct selling laws and regulations, like the industries it regulates, has experienced too many expectations and twists and turns. The promulgation of direct selling laws and regulations is of epoch-making significance to China's direct selling industry, which indicates that China's direct selling has entered the era of legalization, but this does not mean that the spring of all direct selling enterprises has arrived. ...

China should legislate for direct selling when it joined the wto in 200 1, and the time limit for opening direct selling was specified in its commitment to open non-fixed sales (direct selling) within three years. Therefore, the direct selling industry has to be treated with caution by the government. It is also from that time that the topic of direct selling legislation has been a hot topic in the industry. On the one hand, regular and well-run enterprises are cautious and low-key, while on the other hand, various pyramid schemes and disguised pyramid schemes are active in the name of direct sales. The chaos of direct selling-the two "pushes" are not divided

Today's wealth: the noisy "Regulations on Direct Selling Management" was finally promulgated, and people in the industry cheered. However, many people are quite critical of the specific content of the regulations, and even say that direct selling is completely Chinese, and it is forbidden to ban multi-level direct selling in violation of international regulations. The promulgation and implementation of "Regulations on Direct Selling Management" and "Regulations on Prohibiting MLM" are aimed at guiding and standardizing the healthy development of China's direct selling industry. Generally speaking, the healthy development of China's direct selling industry depends on many basic conditions: the law-abiding operation of enterprises and the integrity and goodwill of rebuilding the industry; the perfection and strict implementation of government supporting measures after legislation (supervising direct selling and cracking down on pyramid selling); a good corporate culture and standardized corporate management; the correct guidance of employees' mentality and the cultivation of citizens' mature consumer psychology; and the improvement of social progress and civilization. Most importantly, the society should have a rational understanding of direct selling.

First, review the history of direct selling.

Observe the whole development process of direct selling in China, whether it is free development period (1990-1995), restricted development period (1995 ~ 1998 April) or total ban period (including transformation operation, 1998 April). It is manifested in:

(A) irrational operators-game mentality

In the irrational period of 15, most enterprises engaged in direct selling have a weak awareness of law-abiding operation and a serious mentality of playing games with national policies. The foreign direct selling enterprises that dominate the direct selling market (including foreign-funded enterprises in the later period) failed to correctly cope with the national conditions of China, refused to accept the regulation of China government policies, blindly promoted foreign direct selling business ideas, and attempted to impose foreign relevant legal systems and corporate values on China society. When the business model and interest orientation of enterprises conflict with government policies, they do not actively adjust their business behavior in good faith, but adopt the wrong attitude and practice of evading national laws and policies, and some even mislead the government and society.
