Historical evolution of procuratorial organs
China's procuratorial system and system was originally established on the basis of the Soviet Union, and it is the national legal supervision organ. In Chinese mainland, according to the Constitution of People's Republic of China (PRC) and the Organic Law of the People's Procuratorate of People's Republic of China (PRC), the procuratorial organs, like the people's courts, belong to the state judicial organs, not the administrative organs.

Procuratorial organs are the legal supervision organs of the state and exercise procuratorial power on behalf of the state according to law. The people's procuratorate is produced by the people's congress at the same level, and is responsible to the people's congress and reports its work.

According to the judicial reform resolutions of the Third and Fourth Plenary Sessions of the 18th CPC Central Committee, procuratorial organs below the provincial level will implement vertical leadership in human, financial and material affairs, which is conducive to reducing the possibility of local interference in the judiciary and ensuring the independent status of procuratorial organs.
