Regulations on the Protection of Famous Historical and Cultural Cities, Towns and Villages in Shanxi Province
Chapter I General Provisions Article 1 In order to strengthen the protection and management of historical and cultural cities, towns, villages, blocks and historical buildings, and to inherit outstanding historical and cultural heritage, these Regulations are formulated in accordance with the provisions of relevant laws and administrative regulations and in light of the actual situation of this province. Article 2 These Regulations shall apply to the protection, utilization, supervision and management of historical and cultural cities, towns, villages, blocks and historical buildings within the administrative area of this province. Article 3 The protection of historical and cultural cities, towns, villages, blocks and historical buildings shall adhere to the principles of scientific planning, strict protection and rational utilization. Fourth people's governments at or above the county level shall be responsible for the protection, supervision and management of historical and cultural cities, towns, villages, blocks and historical buildings.

Township (town) people's governments and sub-district offices are responsible for the specific work of the protection and management of famous historical and cultural towns, villages and historical buildings.

Village (neighborhood) committees shall cooperate with the protection of historical and cultural villages and historical buildings. Article 5 The competent department of housing and urban construction of the provincial people's government shall, jointly with the competent department of cultural relics, be responsible for guiding, supervising and inspecting the protection of historical and cultural cities, towns, villages, blocks and historical buildings in the province, formulating relevant standards and norms, and organizing evaluation, evaluation and other related protection work.

The competent department of urban and rural construction planning of the people's government of a city or county (city, district) divided into districts shall, jointly with the competent department of cultural relics, be responsible for guiding and inspecting the protection of historical and cultural cities, towns, villages, blocks and historical buildings, and do a good job in organizing declaration, preliminary examination and other specific protection work in accordance with the prescribed procedures.

Other relevant departments of the people's governments at or above the county level shall, according to their respective functions and duties, do a good job in the protection and management of historical and cultural cities, towns, villages, blocks and historical buildings. Article 6 The people's governments at or above the county level where historical and cultural cities, towns, villages and blocks are located shall arrange protection funds in the fiscal budget at the corresponding level for protection planning, infrastructure and improvement of human settlements.

The people's governments at or above the county level shall arrange funds in the financial budget at the corresponding level for the protection of historical buildings and the training and management of traditional building craftsmen. Seventh encourage enterprises, institutions, social organizations and individuals to participate in the protection of historical and cultural cities, towns, villages, blocks and historical buildings through donations, investments and technical services. Article 8 People's governments at all levels and relevant departments shall organize publicity and education activities on the protection of historical and cultural cities, towns, villages, blocks and historical buildings, popularize protection knowledge, and commend and reward units and individuals who have made outstanding contributions in the protection work. Chapter II Declaration and Identification Article 9 The conditions and procedures for the declaration, approval and direct identification of state-list famous historical and culture cities, famous historical and cultural towns, villages and streets shall be implemented in accordance with relevant state regulations. Article 10 To declare a provincial historical and cultural city, town or village, the following conditions shall be met:

(a) the traditional style buildings are concentrated in pieces;

(two) to retain the traditional pattern and historical features;

(3) It used to be a political, economic, cultural and transportation center, or a military location, or an important historical event occurred, or its traditional industries and major projects built in history had an important impact on the development of this region. Eleventh to declare the provincial historical and cultural blocks, in addition to meeting the provisions of the first and second paragraphs of Article 10, and covering an area of not less than 1 10,000 square meters, it shall also meet one of the following conditions:

(1) It plays an important role in the formation and development of its cities;

(two) closely related to important historical celebrities and major historical events;

(3) Protecting the rich intangible cultural heritage and its sites;

(4) maintain the continuity of traditional life. Twelfth to declare a provincial historical and cultural city, town, village and block, the following materials shall be submitted:

(a) a description of the historical evolution, local characteristics and historical and cultural values;

(two) the status quo of the traditional pattern and historical features;

(3) the scope of protection;

(four) the list of cultural relics protection units and immovable cultural relics that have not been approved and announced as cultural relics protection units;

(5) A list of historical buildings and intangible cultural heritage;

(six) protection objectives, requirements and measures taken. Article 13 To declare a provincial-level historical and cultural city or block, the municipal people's government with districts shall apply, and the competent department of housing and urban-rural construction of the provincial people's government shall, jointly with the competent department of cultural relics, organize relevant departments and experts to demonstrate, put forward audit opinions, and submit them to the provincial people's government for approval and promulgation.

To declare a famous historical and cultural town or village at the provincial level, the people's government of the county (city, district) where it is located shall apply, and the competent department of housing and urban-rural construction of the provincial people's government shall, jointly with the competent department of cultural relics, organize relevant departments and experts to demonstrate, put forward audit opinions, and submit them to the provincial people's government for approval and promulgation. Article 14 For cities, towns and villages that meet the requirements stipulated in Articles 10 and 11 of these Regulations but have not declared provincial-level historical and cultural cities, towns, villages and blocks, the competent department of housing and urban-rural construction of the provincial people's government, jointly with the competent department of cultural relics, may directly make suggestions to the provincial people's government, which shall be approved and promulgated by the provincial people's government.
