Historical buildings declared as cultural relics protection units according to law shall be implemented in accordance with relevant laws and regulations on cultural relics protection. Article 3 The term "historical buildings" as mentioned in these Regulations refers to buildings (structures) that have been confirmed and announced by the Municipal People's Government, have certain protection value, can reflect historical features and local characteristics, and have not been announced as cultural relics protection units according to law.
The term "historical and cultural blocks" as mentioned in these Regulations refers to areas or buildings with high historical, cultural, scientific and artistic value or reflecting the traditional features and regional cultural characteristics of a certain historical period in Chengdu, with rich historical remains and relatively complete preservation of traditional patterns and historical and cultural features. Article 4 The Municipal People's Government shall set up a Committee for the Protection of Historic Buildings and Historic Cultural Blocks (hereinafter referred to as the Protection Committee), which shall be responsible for overall planning, coordination and guidance of the protection of historic buildings and historic cultural blocks in the whole city, and study, decide and solve major problems in the protection of historic buildings and historic cultural blocks within its administrative area.
The working rules of the Protection Committee shall be formulated by the Municipal People's Government. Article 5 The municipal, district (city) and county people's governments shall strengthen the protection of historical buildings and historical and cultural blocks within their respective administrative areas, and incorporate them into the national economic and social development plan and the overall urban and rural planning.
The municipal real estate department is responsible for the supervision and management of the protection of historical buildings in this Municipality, and the historical building protection management institution under the municipal real estate department specifically undertakes the business management and guidance of the protection of historical buildings in this Municipality. District (city) county real estate department is responsible for the daily supervision and management of the protection of historical buildings in this area.
The municipal planning department undertakes the planning and management of historical buildings and historical and cultural blocks in this Municipality, and is responsible for the supervision and management of the protection of historical and cultural blocks in this Municipality. District (city) county planning department shall undertake the planning and management of historical buildings and historical and cultural blocks within its jurisdiction, and be responsible for the daily supervision and management of the protection of historical and cultural blocks within its jurisdiction.
Construction, culture, finance, land and resources, public security, industry and commerce, urban management, forestry and gardens, tourism, folk religion and other relevant departments shall do a good job in the protection of historical buildings and historical and cultural blocks within their respective functions and duties. Article 6 An expert advisory committee on the protection of historical buildings and historical and cultural blocks (hereinafter referred to as the expert advisory committee) shall be established in this Municipality. The Expert Advisory Committee is composed of professionals in real estate, architecture, planning, land and experts in history, culture, architecture, economy and law, and is responsible for the appraisal of the identification, adjustment, revocation, management and protection of historical buildings and historical and cultural blocks, and provides advice for relevant government decisions.
The specific composition and working rules of the expert advisory committee shall be formulated by the Municipal People's government. Article 7 The protection of historical buildings and historical and cultural blocks shall follow the principles of unified planning, classified management, effective protection and rational utilization. Article 8 The municipal, district (city) and county people's governments shall guarantee the protection funds for historical buildings and historical and cultural blocks, and include the protection funds in the fiscal budget at the same level for special protection and management.
Other sources of protection funds include:
(a) donations from units, individuals and other organizations;
(2) Other funds raised according to law.
The use and management of protection funds shall be subject to the supervision of relevant departments and society. Article 9 All units and individuals have the obligation to protect historical buildings and historical and cultural blocks according to law, and have the right to dissuade and report acts that damage or destroy historical buildings and historical and cultural blocks.
City, district (city) county real estate, planning departments should establish a corresponding complaint reporting acceptance system, timely investigate and deal with relevant illegal acts, and publish the results. Tenth units and individuals that have made outstanding contributions in the protection of historical buildings and historical and cultural blocks shall be commended by the municipal, district (city) and county people's governments. Chapter II Identification of Historical Buildings and Historical and Cultural Blocks Article 11 The municipal real estate and planning departments shall regularly organize general surveys of historical buildings and historical and cultural blocks.
Owners, users and other units and individuals of buildings (structures) may recommend historical buildings and historical and cultural blocks to relevant departments. Twelfth buildings (structures) that have been built for more than 50 years and meet one of the following conditions can be identified as historical buildings:
(a) related to major historical events, revolutionary movements, famous figures or important organizations;
(two) reflect the excellent history and culture, and reflect the traditional features of urban and rural areas, the characteristics of the times and local characteristics;
(three) architectural style, structure, materials, construction technology and engineering technology have architectural artistic characteristics and scientific research value;
(4) masterpieces by famous architects;
(5) representative workshops, shops and factories in the history of industrial development;
(six) other important historical significance, commemorative significance or educational significance.
Buildings (structures) that have been built for more than 30 years but less than 50 years, but have special historical, scientific and artistic value or special commemorative and educational significance, can be identified as historical buildings.
Outstanding modern buildings and industrial heritages published by this Municipality can be recognized as historical buildings if they meet the conditions for the recognition of historical buildings.
