The term "green building" as mentioned in these Regulations refers to high-quality civil buildings that save resources, protect the environment, reduce pollution, provide people with healthy, safe, applicable and efficient use space, and realize the harmonious coexistence between man and nature in the whole life cycle of the building. According to national standards, green buildings are classified into basic, one-star, two-star and three-star grades from low to high. Article 3 The construction of new civil buildings within the urban development boundary determined by the land and space planning shall be carried out in accordance with the basic standards.
Public buildings with a construction area of more than 3,000 square meters or mainly invested by the government and other public buildings with a construction area of more than 20,000 square meters shall be constructed in accordance with the standard of one-star or above. Encourage other public buildings and residential buildings to be built according to the standard of one star or above.
More than one kind of renewable energy should be applied to new public buildings with a single building area of more than 3000 square meters and new public buildings with a single building area of more than 20000 square meters. Article 4 The people's governments at or above the county level shall promote the development of green buildings, formulate policies to support the development of green buildings, restrict the construction methods with high resource consumption and large carbon emissions, and incorporate the development of green buildings into the national economic and social development plan, and take it as the content of the government's target responsibility assessment.
People's governments at or above the county level shall increase capital investment, promote the development of green buildings, and encourage and guide social capital to invest and operate green buildings. Fifth people's governments at or above the county level shall be responsible for the guidance, supervision and management of the development of green buildings within their respective administrative areas.
The departments of development and reform, natural resources, industry and informatization, science and technology, education, finance, ecological environment, market supervision and management, urban management and government affairs of the people's governments at or above the county level shall do a good job in the development of green buildings according to their respective responsibilities. Article 6 People's governments at or above the county level shall publicize green buildings, popularize green architectural knowledge, guide citizens to enhance their awareness of green development, and promote the formation of a green lifestyle through green building project demonstration, product display, technical exchange and design competition.
The people's governments at or above the county level shall strengthen the introduction and training of green building talents and train green building practitioners in a planned way.
Encourage industry associations and other organizations to carry out activities such as publicity, training and technology promotion of green buildings. Seventh people's governments at or above the county level shall establish a green building credit information management system, improve the credit system of green building industry, and incorporate green building employees and their behaviors into the social credit system. Chapter II Planning and Construction Article 8 The competent department of housing and urban and rural construction of the people's government at or above the county level shall, in conjunction with the departments of development and reform and natural resources, organize the preparation of the development plan of green buildings in their respective administrative areas, and report it to the competent department of housing and urban and rural construction of the people's government at the next higher level for the record and make it public.
The development planning of green buildings should define the development objectives, safeguard measures, overall layout, key development areas, application of renewable energy, green construction methods and green transformation of existing civil buildings, and determine the targets and paths of carbon emission reduction.
The provincial people's government shall supervise the people's governments of cities, autonomous prefectures and counties with districts to implement the green building development plan. The people's governments of cities and autonomous prefectures with districts shall supervise the implementation of the green building development plan of the people's governments at the county level. Article 9 The competent department of natural resources of the people's government at or above the county level shall incorporate the spatial layout in the development planning of green buildings into the national spatial planning, and rationally plan urban ventilation corridors in combination with the layout of green buildings; Green building grades and green construction methods will be included in the detailed planning as the main index system. Article 10 The competent department of development and reform of the people's government at or above the county level shall, when examining and approving civil construction projects invested by the government, examine whether the grade of green buildings and green construction methods meet the requirements of detailed planning, and include the requirements of green buildings in the scope of energy-saving assessment and review of fixed assets investment projects.
The competent department of natural resources of the people's government at or above the county level shall, when transferring or allocating land, incorporate green building grades and green construction methods into the contract for transferring the right to use state-owned land or the opinions on pre-examination and site selection of construction land.
The competent department of natural resources of the people's government at or above the county level shall review the planning scheme of civil construction projects and verify whether the newly-built civil buildings meet the planning conditions such as green building grades and green construction methods. Eleventh construction units should be in accordance with the detailed planning to determine the level of green building requirements for construction.
The project proposal, feasibility study report or project application report of a new civil construction project shall include the green building grade and green construction method, and the related construction cost of green building shall be included in the project investment estimation.
When a construction unit entrusts the design, construction and supervision of a newly-built civil building project, it shall specify the requirements of green building grades, green construction methods and the application ratio of green building materials in the contract, and shall not express or imply that the entrusted unit carries out engineering design, construction and supervision in violation of the requirements of green building.
If a new civil construction project must be subject to tender according to law, the tenderer shall specify the requirements of the green building grade, green construction method and application ratio of green building materials in the tender documents.
