Regulations of Zhejiang Province on the Protection of World Cultural Heritage of the Grand Canal
Article 1 In order to strengthen the protection of the world cultural heritage of the Grand Canal in China (hereinafter referred to as the Grand Canal Heritage), carry forward excellent culture, inherit human civilization, and promote coordinated and sustainable economic and social development, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Protection of Cultural Relics and other relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the protection of the Grand Canal heritage within the administrative area of this province.

The Grand Canal Heritage as mentioned in these Regulations refers to the rivers and heritage sites of the China-Zhejiang section of the Grand Canal listed in the World Heritage List.

The historical and cultural remains of the Grand Canal, which are not listed in the World Heritage List and have protection value, shall be approved and announced for protection as cultural relics protection units, cultural relics protection sites and historical buildings according to law. Article 3 The protection of the Grand Canal heritage shall implement the policy of cultural relics work, adhere to the principles of giving priority to protection, live transmission and rational utilization, and safeguard the authenticity, integrity and continuity of the Grand Canal heritage. Article 4 The people's governments of cities and counties (cities, districts) in provinces and related districts (hereinafter referred to as the people's governments at or above the county level) shall be responsible for the protection of the Grand Canal heritage within their respective administrative areas, establish and improve the comprehensive coordination mechanism for protection, ensure the work force, incorporate the protection of the Grand Canal heritage into the national economic and social development plan and the land and space plan, and incorporate the required funds into the fiscal budget. Heritage protection of the Grand Canal is included in the performance appraisal system of local governments.

The comprehensive coordination mechanism for heritage protection of the Grand Canal should clarify the responsibilities of departments and coordinate and solve major problems of heritage protection. The specific work of comprehensive coordination shall be undertaken by the administrative department of cultural relics. Article 5 The administrative department of cultural relics of the people's governments at or above the county level shall be responsible for the organization, guidance, supervision and management of the heritage protection of the Grand Canal.

Other relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in the protection and management of the Grand Canal heritage.

Township (town) people's governments and sub-district offices shall, in accordance with regulations, do a good job in the protection of the Grand Canal heritage within their respective jurisdictions.

Village (neighborhood) committees shall cooperate with the protection of the Grand Canal heritage. Article 6 The institution responsible for the river length system shall include the protection of the Grand Canal heritage river in its scope of work and the assessment of river lengths at all levels.

The administrative department of cultural relics shall inform the river chiefs at all levels of the specific scope and matters of the protection of the Grand Canal heritage river in writing. Article 7 The municipal people's governments of provinces and districts shall organize the preparation of the Grand Canal heritage protection plan, which shall be promulgated and implemented with the consent of the administrative department of cultural relics at the next higher level.

The formulation of the grand canal heritage protection plan should solicit the opinions of relevant departments, experts and the public.

Before submitting it to the administrative department of cultural relics at the next higher level for review, the people's governments of provinces and municipalities with districts concerned shall submit the heritage protection plan of the Grand Canal to the meeting of the Standing Committee of the people's congress at the corresponding level for deliberation. The deliberation opinions of the members of the Standing Committee shall be submitted to the people's government at the corresponding level for study and handling.

The approved Grand Canal Heritage Protection Plan shall not be adjusted or modified without authorization; If it is really necessary to adjust or modify the planning content, the examination and approval procedures shall be re-performed. Article 8 The heritage protection planning of the Grand Canal is an important basis for the protection and management of the Grand Canal.

The planning for the conservation of the Grand Canal heritage should specify the overall protection requirements, protection zones, classification and grading standards, protection priorities and safeguard measures of the Grand Canal heritage.

The grand canal heritage protection planning in relevant areas should be based on the provincial grand canal heritage protection planning, and the specific protection measures and control requirements should be clarified.

All kinds of regional planning and special planning involving the water body, coastline and environment of the Grand Canal shall conform to the heritage protection planning of the Grand Canal. Article 9 The Grand Canal Heritage Protection Area is divided into heritage area and buffer area. Heritage site refers to the protected area of the Grand Canal heritage itself and its surrounding areas. Buffer zone refers to the area where construction activities are restricted outside the heritage area in order to protect the safe environment, historical features and gallery landscape of the Grand Canal heritage.

The Grand Canal heritage, which has been announced as a national key cultural relics protection unit, is inconsistent with the heritage area and buffer zone in terms of its protection scope and construction control zone, and the provincial people's government may make adjustments according to law, but the protection scope shall not be less than the heritage area and the construction control zone shall not be less than the buffer zone. Tenth heritage protection areas shall not carry out engineering construction or blasting, drilling, excavation and other operations; However, if it is really necessary to carry out the following engineering construction or blasting, drilling, excavation and other operations in the heritage area, the approval procedures shall be performed in accordance with the relevant provisions of the Law of People's Republic of China (PRC) on the Protection of Cultural Relics:

(1) Engineering construction, landscape maintenance, environmental improvement and transformation of historical and cultural blocks related to the protection of the Grand Canal heritage;

(two) flood control and drainage projects and the construction of hydrometeorological monitoring facilities;

(3) Construction of navigation channels, ports, bridges across rivers, tunnels and water traffic safety facilities;

(four) other projects required by special circumstances.

The project construction in the heritage area shall conform to the Grand Canal heritage protection plan, avoid the relevant historical sites and sites left by the Grand Canal water conservancy project, and adopt the construction technology with the least impact on the Grand Canal heritage. If it is unavoidable due to special circumstances, the original site protection shall be implemented as far as possible in accordance with the provisions of relevant laws and regulations.
