First, about children's shelters.

(a) the reason why the city was mobilized and assigned to other provinces and cities (hereinafter referred to as "educated youth"), the current account has returned to Shanghai to settle down, and their children can return to Shanghai to settle down in any of the following circumstances:

1. The educated youth in this city have no children, and the children legally adopted before the household registration returns to Shanghai, who have lived in this city with their adoptive parents for a long time, are under 25 years old, unmarried and childless, and are unemployed in other provinces and cities, can settle in the place where their adoptive parents are registered;

2. Children born to educated youth in this city, who have completely lost their ability to take care of themselves due to illness, injury or severe physical disability, need parental care, live with their parents for a long time, and are unmarried, childless and unemployed in other provinces and cities, can settle in their parents' registered permanent residence.

(2) If the educated youth in this city have no children to settle in Shanghai, they can take care of a biological child who is unmarried, childless, unemployed in other provinces and cities, and has a long-term practical life foundation in this city, or a grandchild who meets the above requirements and is over 16 years old but not more than 25 years old, and settle in the legal residence owned by the applicant himself.

If the detainee is a minor, he shall entrust a permanent resident of this Municipality to take care of him.

(three) minor children born to people from other provinces and cities and the permanent population of this Municipality (the household registration of this Municipality has reached 5 years) shall be handled in accordance with the following provisions:

1. Only child born to parents, born out of wedlock. If the child obtains the one-child certificate or the father (mother) obtains the honor certificate of the one-child parents, he/she can settle in the place where the father (mother) has registered permanent residence;

2. If the permanent residence of this city is cancelled due to death, sentence and other reasons, and the children born in other provinces and cities that meet the family planning policy have been living in this city since birth, they can settle in the place where their grandparents' accounts are located; If the grandparents (from other places) die or disagree to settle down, they can settle down in the legal residence of themselves, their relatives or those who are willing to accept them to settle down in this city.

(4) A minor stepson (female) who has moved to Shanghai with his father (mother) and is born in line with the family planning policy may move with him if his father (mother) has custody for five years and his stepfather (mother) has lived in Shanghai for five years.

Second, about the husband and wife take refuge

(a) the city branch, educated youth and their children and permanent residents of this city (registered in this city for 5 years) have been married for 5 years, and can be settled in the location of their spouse's household registration.

(two) ethnic minorities and overseas Chinese with permanent residence in this city (registered in this city for 7 years) who have been married for 7 years can settle in the place where their spouse's residence is located.

(3) After a person from other provinces and cities marries a person with permanent residence in this city, one party dies in this city, and the children born with one party in this city have been registered in this city, and the people from other provinces and cities have not remarried, and the actual residence base is childless in this city and other provinces and cities; Or other provinces and cities have children, but they are all adults, and the children registered in this city are not yet adults. You can refer to item (1) of "No.70 [2009] of Hufu" to settle down in the place where your children's household registration is located.

Thirdly, about the elderly taking refuge.

Employees, educated youth who work in this city, or those who work in other provinces and cities for other reasons (hereinafter referred to as "emigrants") and their spouses who have reached the legal age of retirement in the country, or elderly people who have reached the age of 60 for men and 55 for women, can return to Shanghai to settle down if they meet one of the following conditions:

(a) both husband and wife are foreigners in this city, according to the following provisions:

1. You can settle down at the same time or successively in the place where the children are registered;

2 childless, can be at the same time or successively in their parents, brothers and sisters account location, or I, relatives in the city's legal residence;

3. If there are no children in other provinces and cities, and their children in this city have their accounts cancelled due to enlistment, going abroad (border), death (disappearance), serving sentences, etc., they can settle in the place where their parents, brothers and sisters have their accounts, or their relatives legally live in this city.

(two) one of the spouses is a migrant population in this city, and one of the spouses has been registered for marriage in other provinces and cities for 10 years, which shall be handled in accordance with the following provisions:

1. You can settle down at the same time or successively in the place where the children are registered;

2. Childless, if one of the husband and wife is an educated youth in this city and enjoys social insurance benefits, they can register in their parents', brothers and sisters' accounts, or their own relatives can settle in their legal residences in this city; Do not enjoy social insurance benefits, should be settled in the city's own legal residence. Spouses from other provinces and cities can move with them, or the educated youth in this city can apply after returning to Shanghai to settle down;

3. The educated youth in this city has died, and if their spouses have not remarried in other provinces and cities, they can settle in the place where their children are registered;

4 for other reasons to work in other provinces and cities, the original city hukou personnel died, their spouses in other provinces and cities have not remarried, and other provinces and cities have no children, they can settle in their children's accounts.

(three) the city's migrants are single elderly people who have not given birth or adopted children, and can settle in the place where their parents, brothers and sisters account, or their relatives legally live in this city.

Fourth, others.

(1) "Personnel who have been mobilized and assigned to work in other provinces and cities" refers to the educated youth who once had household registration in this city and were later mobilized and assigned to other places to support foreign construction.

Although these people can't provide supporting documents to prove that they have been transferred to other provinces and cities in the process of handling household registration in this city, if their children have returned to Shanghai as branch committees, branches and educated youth children, they can be regarded as "people who have been transferred to work in other provinces and cities".

(2) "Personnel who work in other provinces and cities for other reasons" refers to those who originally have the household registration in this city, but does not include those who have the collective household registration of college students in this city, the collective household registration of students in scientific research units, and the work account of the offices of the central ministries and commissions in Shanghai.

(3) "Unemployed people in other provinces and cities" refers to the situation that the household registration personnel in other provinces and cities have never been employed in the place where they are registered, or have terminated their labor contracts with the work units where they are registered for five years.

(4) "Legal domicile" refers to the house with Shanghai real estate certificate, house ownership certificate, public housing lease certificate or other house certificates stipulated by laws, regulations and rules.

(five) in line with the city's policy of migration of refuge accounts, the applicant shall obtain the consent of the city's refuge before going through the formalities of settlement. Applicants with more than one refuge address shall, in principle, settle in their habitual residence. Due to family conflicts or other historical issues, the account cannot be closed. Upon the written application of the applicant, and confirmed by the local police station, neighborhood (village) committee and relevant departments, they can settle in the legal residence of the applicant and his relatives in this city.

(six) in line with the city's asylum account migration policy, when the account is approved to settle in Shanghai, their minor children in line with the family planning policy can move with it, but "1. Provisions in Children's Shelter (4) ".

(seven) the provisions of the policy of husband and wife refuge only apply to unemployed people whose spouses are from agricultural registered permanent residence or agricultural registered permanent residence, or who retire at the legal age of the country, or who are 60 years old for men and 55 years old for women. However, applicants who violate the family planning policy may not take refuge.

(eight) the city's refuge account migration policy does not apply to the city's collective account personnel.

(10) In the implementation of these Provisions, once it is found that there are acts of concealing facts and practicing fraud in the process of reimbursement, the public security organs of this Municipality will cancel the accounts of those who have defrauded and illegally settled in their original places of residence according to the Reply of the Ministry of Public Security on Issues Related to the Restoration of Accounts of Persons with Cancelled Accounts and the relevant provisions of this Municipality, return them to their original places of residence, and investigate the legal responsibilities of the relevant personnel according to law; Those who participate in fraud and use false materials to declare accounts will be included in the personal credit registration system established in this Municipality in accordance with the provisions of this Municipality's credit system.
