Measures for the protection of famous historical and cultural cities and towns in Suzhou
Chapter I General Provisions Article 1 In order to strengthen the protection of famous historical and cultural cities and towns and inherit and develop outstanding historical and cultural heritage, these Measures are formulated in accordance with the provisions of the Planning Law of People's Republic of China (PRC), the Law on the Protection of Cultural Relics of People's Republic of China (PRC) and the Regulations on the Protection of Famous Historical and Cultural Cities and Towns of Jiangsu Province, and in combination with the actual situation of this Municipality. Article 2 These Measures shall apply to the protection of famous historical and cultural cities and towns within the administrative area of this Municipality. Article 3 The local people's governments of famous historical and cultural cities and towns shall set up a management committee for the protection of famous historical and cultural cities and towns to organize, coordinate and supervise the protection of famous historical and cultural cities and towns within their respective jurisdictions.

City, county-level city planning administrative departments, in charge of the planning of the protection of historical and cultural cities and towns within their respective administrative areas.

City, county-level city (District) cultural relics administrative departments, in charge of the administrative area of historical and cultural cities and towns of cultural relics protection. Article 4 The administrative departments of construction, land, housing management, public security, finance, environmental protection, urban management, water affairs, tourism, landscaping, ethnic and religious affairs shall, according to their respective functions and duties, jointly do a good job in the protection of famous historical and cultural cities and towns. Article 5 The local people's governments of famous historical and cultural cities and towns shall incorporate the protection work into the national economic and social development planning and urban and rural construction planning, and arrange special protection funds.

The protection of historical and cultural cities and towns must adhere to the principles of overall planning, effective protection, rational utilization and scientific management, and correctly handle the relationship between protection and utilization, inheritance and development, cultural relics protection and economic construction and social development. Article 6 All units and individuals have the right and obligation to protect famous historical and cultural cities and towns, and shall stop and report any violation of these measures. Chapter II General Provisions Article 7 Famous historical and cultural cities and towns shall be declared by the municipal and county (district) people's governments in accordance with the following provisions:

(a) Suzhou Municipal People's government to declare, by the municipal planning administrative departments and cultural relics administrative departments to organize the application materials, to the provincial people's government to declare;

(II) the county-level city (District) people's government to declare, by the county-level city (District) people's government will declare materials, with the consent of the Suzhou Municipal People's government, submitted to the provincial people's government for approval and publication. Article 8 The Suzhou Municipal People's Government shall register and announce the towns that have not been approved and announced as famous historical and cultural cities, but are indeed of protection value after investigation, as controlled protection ancient towns, ancient villages, historical blocks and ancient buildings. Ninth historical and cultural cities and towns are mainly protected:

(a) the original overall spatial environment of the town, including the pattern of the ancient city (town) and the overall style. ;

(two) the traditional style of historical blocks;

(3) water system;

(4) Underground cultural relics burial areas;

(five) ancient cultural sites, ancient buildings, stone carvings, important historical sites and representative buildings in modern times, ancient and famous trees, landform relics, etc. With cultural relics value;

(six) oral or other intangible cultural heritage with local characteristics, such as traditional operas, traditional crafts, traditional industries and folk customs. Tenth historical and cultural cities and towns protection planning approval:

(a) the preparation and examination and approval of the protection plan for famous historical and cultural cities and towns shall be implemented in accordance with the relevant provisions of the state and the province;

(2) The controlled protection plan for ancient towns, villages, historical blocks and ancient buildings determined by the Suzhou Municipal People's Government shall be compiled by the local people's government at or above the county level within two years after the name is announced and submitted to the Suzhou Municipal People's Government for approval as an important part of the overall urban planning;

(3) The protection plan for famous historical and cultural cities and towns shall be announced to the public, and the opinions of experts, scholars, the public and relevant departments shall be extensively solicited, scientifically demonstrated and hearings shall be held when necessary;

(four) involving the adjustment of protection planning, according to the original examination and approval procedures. Eleventh preparation of historical and cultural cities and towns protection planning, should be based on the historical features and the status quo of the elements, the delineation of key protected areas. Protection planning should include urban landscape design or urban design in key areas, and strictly control building density and building height. Twelfth people's governments at all levels shall set up special protection funds for historical and cultural cities and towns. Funds can be raised through the following channels:

(1) Financial funds;

(2) bank loans;

(3) private equity funds;

(4) Operating income;

(5) donation;

(6) Other legal sources. Thirteenth historical and cultural cities and towns protection measures:

(a) land use and construction must conform to the approved protection plan;

(two) land use and construction must be declared and approved according to legal procedures;

(three) the construction unit must carry out construction in accordance with the requirements of the construction project planning permit, and effectively protect the cultural relics and their surrounding ancient and famous trees, water systems, landforms, etc. , and shall not cause pollution or damage;

(four) when the construction unit finds the above-ground and underground cultural relics in the construction process, it shall immediately stop the construction, protect the site, and report to the cultural relics administration department in time;

(five) the use function of buildings and structures meets the requirements of protection planning, and must be safe and reasonable in the use process;

(six) tourism activities and other activities shall not destroy the traditional culture, style and pattern, and shall not pollute or destroy the environment and water system. Fourteenth historical and cultural cities and towns in key protected areas shall not carry out the following activities:

(a) the destruction of traditional style advertising and facade decoration, roof advertising;

(two) the planning landscape corridor that blocks the important cultural relics with overlooking function;

(3) breaking the wall and opening a shop;

(four) engaged in the exploitation of underground mineral resources and other resources;

(five) other acts prohibited by laws and regulations.
