Regulations of Xiangtan Municipality on the Protection of Historical Buildings and Historical and Cultural Blocks
Chapter I General Provisions Article 1 In order to strengthen the protection and management of historical buildings and historical and cultural blocks in this Municipality, inherit and carry forward Xiangtan's excellent history and culture, and promote the coordinated development of urban and rural construction and social culture, these Regulations are formulated in accordance with the Urban and Rural Planning Law of People's Republic of China (PRC), the Regulations on the Protection of Famous Historical and Cultural Cities, Towns and Villages and other laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the protection and management of historical buildings and historical and cultural blocks within the administrative area of this Municipality.

The term "historical buildings" as mentioned in these Regulations refers to buildings (structures) that have been confirmed and announced by the people's governments of cities and counties, have certain protection value, can reflect historical features and local characteristics, have not been announced as cultural relics protection units, and have not been registered as immovable cultural relics.

The term "historical and cultural blocks" as mentioned in these Regulations refers to areas that have been approved and promulgated by the provincial people's government, are particularly rich in preserved cultural relics, and are concentrated in historical buildings, which can comprehensively and truly reflect the traditional pattern and historical features and have a certain scale. Article 3 The protection and management of historical buildings and historical and cultural blocks shall follow the principles of scientific planning, effective protection, rational utilization and standardized management, and maintain the authenticity, integrity and sustainability of historical buildings and historical and cultural blocks. Article 4 The people's governments of cities and counties (cities, districts) shall be responsible for the protection and management of historical buildings and historical and cultural blocks within their respective administrative areas, and establish a linkage mechanism for the protection of historical buildings and historical and cultural blocks.

Township (town) people's governments and sub-district offices shall perform the duties of daily inspection and on-site protection of historical buildings and historical and cultural blocks. Fifth urban and rural planning administrative departments responsible for the supervision and management of historical buildings and historical and cultural blocks.

The construction administrative department is responsible for the supervision and management of the structural safety of buildings (structures) or other facilities within the scope of historical buildings and historical and cultural blocks.

The administrative department of cultural relics is responsible for sorting out the historical data and information of the protected objects, excavating and evaluating their historical value, and assisting the competent department of urban and rural planning to do a good job in the supervision and management of the general survey, declaration and formulation, protection planning and approval of related construction activities of historical buildings and historical and cultural blocks.

The relevant administrative departments in charge of urban management, culture, land and resources, finance, public security, environmental protection, industry and commerce, education, tourism, ethnic groups and religions shall, according to their respective functions and duties, do a good job in the protection of historical buildings and historical and cultural blocks. Article 6 The people's governments of cities and counties (cities) shall organize the preparation of protection plans for historical and cultural blocks within their respective administrative areas and submit them to the provincial people's government for approval; City, county (city) people's government administrative departments of urban and rural planning shall organize the preparation of historical buildings protection planning within their respective administrative areas and report to the people's government at the same level for approval.

Before the protection plan is submitted for examination and approval, it shall be announced to the public to solicit opinions from relevant departments, experts and the public; When necessary, a hearing shall be held. Article 7 The Municipal People's Government shall set up an expert advisory committee on the protection of historical buildings and historical and cultural blocks (hereinafter referred to as the expert advisory committee). The Expert Advisory Committee is composed of experts in the fields of planning, architecture, culture, cultural relics, history, real estate, tourism, environmental protection, fire protection and law, and provides decision-making consultation for the identification of historical buildings and the protection, utilization and management of historical buildings and historical and cultural blocks. Article 8 The people's governments of cities and counties (cities, districts) shall arrange protection funds to be used exclusively for the protection and management of historical buildings and historical and cultural blocks.

The sources of protection funds include:

(a) the superior financial special subsidy funds;

(two) city and county (city, district) financial budget funds;

(3) Donations from units and individuals;

(four) the proceeds from the transfer, lease, exhibition or other rational utilization of state-owned historical buildings;

(5) Other funds raised according to law.

The specific measures for the use and management of protection funds shall be formulated separately by the people's governments of cities and counties (cities, districts). Ninth to encourage social forces to participate in the protection of historical buildings and historical and cultural blocks in various ways.

Any unit or individual has the right to put forward opinions and suggestions on the protection and management of historical buildings and historical and cultural blocks, and discourage and report acts of destroying historical buildings and historical and cultural blocks.

The administrative department of urban management and the administrative department of urban and rural planning shall announce the way of reporting, promptly investigate and deal with acts that endanger historical buildings and historical and cultural blocks, and feed back the results to the informants. Tenth units and individuals that have made outstanding contributions to the protection of historical buildings and historical and cultural blocks shall be commended and rewarded by the people's governments of cities and counties (cities, districts). Eleventh city and county (city, district) people's government should strengthen the publicity and education of the protection of historical buildings and historical and cultural blocks, popularize the knowledge of protection, and raise the awareness of the people of the whole city. Chapter II Identification of Historical Buildings Article 12 A building (structure) that meets one of the following conditions may be identified as a historical building:

(a) the architectural style, structure, materials, construction technology or engineering technology have architectural artistic characteristics or scientific research value;

(2) Reflecting Xiangtan's history, culture and folk traditions, with the characteristics of the times and regions;

(3) Workshops, shops, factories, warehouses, docks and bridges are representative or typical in Xiangtan's economic and social development history;

(four) related to major historical events or famous people;

(five) other historical, scientific, artistic and social values, or commemorative and educational significance.
