Marxism has given a scientific explanation to this problem. The analysis and elaboration of the origin of law by Marxism also has a process of gradual deepening and development. From May 1872 to June 1873, Engels wrote a series of important articles on the improvement plan of bourgeois philanthropists to solve the housing problem of the working class spread by proudhon, which was published in People's National newspaper successively, and then published a pamphlet entitled "On Housing Problem". In On Housing, Engels deeply analyzed the theoretical basis of proudhon's solution to the housing problem-"eternal fairness" theory, clearly pointed out that in capitalist society, solving the housing problem is always beneficial to the bourgeoisie, and bourgeois laws can't solve the housing problem, and scientifically revealed the internal relationship among law, jurisprudence and socio-economic conditions, and analyzed and expounded the origin of law. However, due to the historical limitations of scientific data and research results, it was not until the late 1970s of 19 that the rapid progress of anthropological research, especially Lewis henry morgan's authoritative achievements on prehistory, provided objective conditions for answering Engels' doubts. The Origin of Family, Private Ownership and State is an outstanding Marxist work on the issue of state and law written by Engels on the basis of Morgan's research results, and it is also a stereotyped Marxist work on the issue of the origin of law.
