The protection and management of historical buildings within the administrative area of this province shall be implemented in accordance with the relevant provisions of these regulations. Article 3 People's governments at all levels are responsible for the protection, supervision and management of historical and cultural cities, blocks, towns and villages within their respective administrative areas, and incorporate the protection of historical and cultural cities, blocks, towns and villages into the national economic and social development plan, and the required funds into the fiscal budget at the corresponding level. Article 4 The people's governments of cities and counties where historical and cultural cities are located shall set up protection committees, and the people's governments of cities and counties where historical and cultural blocks, towns and villages are located may set up protection committees.
The Protection Committee is composed of responsible persons of the people's government, responsible persons of relevant departments, relevant experts and public representatives, and is responsible for studying major issues in the protection and management of historical and cultural cities, blocks, towns and villages, and coordinating and supervising the implementation of the protection plan. Article 5 The competent department of urban and rural planning of the people's government at or above the county level shall, jointly with the competent department of cultural relics at the same level, be responsible for the declaration of historical and cultural cities, blocks, towns and villages within their respective administrative areas, the preparation and implementation of protection plans, supervision and inspection and other specific work.
Other relevant departments shall, according to their respective responsibilities, do a good job in the protection, supervision and management of historical and cultural cities, blocks, towns and villages.
Village (neighborhood) committees shall cooperate with the protection of historical and cultural cities, blocks, towns and villages. Article 6 The provincial people's government and the people's governments of cities and counties where historical and cultural cities, blocks, towns and villages are located shall set up special protection funds for protection planning, improvement of infrastructure and living environment, and protection of historical buildings. Sources of special funds for protection include:
(1) Funds arranged in the fiscal budget at the corresponding level;
(two) the superior financial special subsidy funds;
(three) donations from domestic and foreign units and individuals;
(4) Other legally raised funds. Seventh people's governments at all levels and relevant departments should organize publicity and education activities on the protection of historical and cultural heritage, popularize protection knowledge, and enhance the protection awareness of the whole society. Article 8 The protection, supervision and management of historical and cultural blocks, famous towns and villages shall ensure the participation of indigenous people and safeguard their legitimate rights and interests.
People's governments at all levels shall take measures to encourage and support units and individuals to participate in the protection of historical and cultural cities, blocks, towns and villages through donations, subsidies and technical services. Chapter II Declaration and Determination Article 9 Historical and cultural cities include national historical and cultural cities and provincial historical and cultural cities.
The conditions and procedures for the declaration, approval and direct determination of famous historical and cultural towns, villages and national historical and cultural cities shall be implemented in accordance with the Regulations of the State Council on the Protection of Famous Historical and Cultural Cities, Towns and Villages. Tenth cities that meet the following conditions can be declared as famous historical and cultural cities in the province:
(a) the preservation of cultural relics is particularly rich;
(2) historical buildings are concentrated in pieces;
(3) keep the traditional pattern and historical features;
(4) It has been used as a political, economic, cultural, transportation center or military place in history, or an important historical event has occurred, or its traditional industries and major projects built in history have had an important impact on the development of this region;
(five) there are more than two historical and cultural blocks approved and announced by the provincial people's government within the scope of protection of historical and cultural cities. Eleventh blocks with the following conditions can be declared as historical and cultural blocks:
(a) the preservation of cultural relics is particularly rich;
(2) historical buildings are concentrated in pieces;
(3) Preserve the traditional pattern and historical features completely and truly;
(4) Its scale meets the standards set by the state. Twelfth buildings and structures that meet one of the following conditions and have not been announced as cultural relics protection units or sites can be identified as historical buildings:
(a) architectural style, structure, materials, construction technology or engineering technology has historical, scientific and artistic value;
(two) reflect the local history and culture and folk traditions, with specific characteristics of the times and regional characteristics;
(3) representative workshops, shops, factories and warehouses in the history of local industrial development;
(4) Modern buildings and structures related to historical events and celebrities;
(five) other buildings and structures of historical value. Thirteenth to declare a historical and cultural city or a historical and cultural block in the province, the following materials shall be submitted:
(1) Historical evolution, local characteristics and historical and cultural values;
(two) the status quo of the traditional pattern and historical features;
(3) the scope of protection;
(four) the list of cultural relics protection units, cultural relics protection sites, historical buildings and intangible cultural heritage;
(five) protection work, protection objectives and protection requirements.
To declare a famous historical and cultural city in the province, a list of historical and cultural blocks and explanatory materials shall also be submitted.
