1. The "Marriage Registration Regulations" require the parties to handle divorce matters

Article 11: Mainland residents who apply for divorce registration shall produce the following certificates and supporting materials:

(1) My household registration book and ID card;

(2) My marriage certificate;

(3) Divorce agreement signed by *** both parties .

Hong Kong residents, Macao residents, Taiwan residents, overseas Chinese, and foreigners who apply for divorce registration shall, in addition to the certificates and certification materials specified in items (2) and (3) of the preceding paragraph, Hong Kong residents , Macao residents, and Taiwan residents should also present their valid passes and identity cards, and overseas Chinese and foreigners should also present their valid passports or other valid international travel documents.

The divorce agreement should state the intention of both parties to divorce voluntarily and the consensus on matters such as child support, property and debt disposal.

Second "Marriage Registration Work Standards" requires parties to handle divorce matters

This is divided into two aspects, one is the personal requirements for the parties; the other is the requirements for marriage The registrar's request requires the parties to cooperate. The details are as follows:

1. The first aspect: personal requirements for the parties involved:

Article 55: The conditions for accepting divorce registration applications are:

( 1) The Marriage Registration Office has jurisdiction;

(2) Both couples seeking divorce must go to the Marriage Registration Office to apply together;

(3) Both parties have full civil rights Capacity;

(4) The parties hold a divorce agreement, which states the intention of both parties to divorce voluntarily and the consensus on matters such as child support, property and debt disposal;

(5) The parties concerned hold a marriage certificate issued by the mainland marriage registration authority or the Chinese embassy (consulate) abroad;

(6) Each party concerned submits two 2-inch singles with recent half-length crowns Photos;

(7) The parties concerned hold valid identity documents as stipulated in Articles 29 to 35 of these regulations.

2 The second aspect: The parties need to cooperate with the requirements of the marriage registrar:

Article 56: The marriage registrar shall follow the following procedures when accepting an application for divorce registration :

(1) Separately ask the parties about their wishes for divorce and the content of the divorce agreement, and make a transcript, which will be signed by the parties after reading it.

(3) If both parties voluntarily divorce and agree on matters such as child support, property and debt settlement, both parties shall fill in the "Declaration for Application for Divorce Registration"; the "declarant" in the "Declaration for Application for Divorce Registration" The signature in one column must be completed and fingerprinted by the declarant in front of the person who administers the oath; the marriage registrar serves as the person who administers the oath and signs in the column of the person who administers the oath.

(4) Both spouses should sign the divorce agreement on the spot.

Article 59: The issuance of a divorce certificate shall be carried out in the presence of both parties and in accordance with the following steps:

(1) Ask and verify the names, dates of birth, divorce certificates of both parties Willingness;

(2) Witness that the party concerned personally signs and presses fingerprints in the "Party's Signature upon Receiving Certificate and Pressing Fingerprints" column of the "Divorce Registration Review and Processing Form"; It cannot be left blank, and it is not allowed for others to fill it in or have their fingerprints taken on their behalf.
