Legal basis: Article 240th of the Criminal Law of People's Republic of China (PRC) refers to the act of abducting, kidnapping, buying, cheating, picking up and transferring women and children for the purpose of selling. The so-called abduction refers to the behavior of the perpetrator to make women and children leave their families or guardians and control them by non-violent means such as seduction and deception. Judging from the constitution of the crime, if there is no intention of kidnapping subjectively and no kidnapping objectively, it cannot constitute the crime of abducting and selling women and children.
