Regulations of Foshan Municipality on the Protection of Historical and Cultural Blocks and Historical Buildings
Chapter I General Provisions Article 1 In order to strengthen the protection and management of historical and cultural blocks and historical buildings in this Municipality, inherit and carry forward excellent traditional culture, and promote the coordinated development of urban construction and history and culture, these Regulations are formulated in accordance with the People's Republic of China (PRC) Urban and Rural Planning Law, the People's Republic of China (PRC) Cultural Relics Protection Law, the Regulations on the Protection of Historical and Cultural Cities, and the Guangdong Urban and Rural Planning Regulations. Article 2 These Regulations shall apply to the protection and management of historical and cultural blocks and historical buildings within the administrative area of this Municipality. Article 3 The protection and management of historical and cultural blocks and historical buildings shall follow the principles of scientific planning, strict protection, giving priority to rescue and rational utilization, and protect the authenticity, integrity and sustainability of historical and cultural blocks and historical buildings. Article 4 The Municipal People's Government shall be responsible for the protection and management of historical and cultural blocks and historical buildings in this Municipality, and establish a linkage responsibility system for the protection of historical and cultural blocks and historical buildings in this Municipality.

The District People's Government shall be responsible for the protection and management of historical and cultural blocks and historical buildings within its administrative area.

The town people's government and sub-district offices perform daily inspections and on-site protection of historical and cultural blocks and historical buildings.

People's governments at all levels shall incorporate the protection and management of historical and cultural blocks and historical buildings into the national economic and social development plan, and provide policy support and financial guarantee; And through the purchase of services, the establishment of district protection and management organizations. Mobilize various social forces to participate in protection and management. Article 5 The competent department of urban and rural planning shall be responsible for the general survey, declaration and identification, directory management, protection planning and emergency protection of historical and cultural blocks and historical buildings, and organize the implementation of these Regulations.

The competent department of cultural relics is responsible for sorting out the historical information of the protected objects, excavating and evaluating their historical value, and assisting the competent department of urban and rural planning to do a good job in the general survey, declaration and identification, protection planning and other work of historical and cultural blocks and historical buildings.

Construction administrative departments are responsible for the supervision and management of buildings, structures or other facilities in historical and cultural blocks, as well as the structural safety, maintenance and repair of historical buildings and other related construction activities.

The urban management department is responsible for the inspection and enforcement of historical and cultural blocks and historical buildings.

The competent departments of public security and fire control, industry and commerce administration shall, in accordance with their respective responsibilities, jointly do a good job in the protection and management of historical and cultural blocks and historical buildings. Article 6 The administrative punishment stipulated in these Regulations shall be implemented by the administrative organ determined by the Municipal People's Government if it belongs to the scope of relatively centralized administrative punishment approved by the people's government of the State Council or the province. Article 7 The expert committee on historical and cultural protection established by the municipal and district people's governments is composed of professionals in planning, architecture, culture, history, land, society, law and economy, and is responsible for reviewing the relevant contents in the protection and management of historical and cultural blocks and historical buildings, and providing advice to the municipal and district people's governments in making decisions. Article 8 The municipal and district people's governments shall arrange protection funds to be used exclusively for the protection and management of historical and cultural blocks and historical buildings.

The sources of protection funds include:

(a) the superior financial special subsidy funds;

(two) funds arranged by the municipal and district budgets;

(three) donations and subsidies from all walks of life;

(four) the proceeds from the transfer, lease, exhibition or other rational utilization of state-owned historical buildings;

(five) the original site protection and historical building relocation funds included in the construction project budget by the construction unit;

(6) Other funds raised according to law.

Protection funds must be earmarked for special purposes, and accept the supervision of the financial and auditing departments. The specific measures for the use and management of the protection fund shall be formulated separately by the municipal and district people's governments. Article 9 The municipal and district people's governments encourage qualified enterprises, institutions, trade associations, research institutions and other social organizations to carry out basic research and professional training related to the protection and management of historical and cultural blocks and historical buildings.

Encourage units and individuals to participate in the protection and management of historical and cultural blocks and historical buildings in accordance with the law through various means such as funding, setting up foundations, setting up public welfare organizations, providing technical services and direct investment.

Any unit or individual has the right to put forward opinions and suggestions on the protection and management of historical and cultural blocks and historical buildings; Have the right to discourage, report and accuse acts of destroying and damaging historical and cultural blocks and historical buildings. Article 10 The Municipal People's Government shall establish an information management and inquiry system for historical and cultural protection, strengthen information exchange and resource sharing among departments, and provide information inquiry services for historical and cultural blocks and historical buildings to the public; Information technology and other means should be used to deepen the public's understanding and cognition of historical and cultural blocks and historical buildings in this city.

Education, culture and other departments should strengthen the ninth grade for students in school, and strengthen the social inheritance consciousness of Foshan's excellent history and culture by setting courses, publishing books and media publicity. Chapter II List of Protection Article 11 The Municipal People's Government shall include historical and cultural blocks and historical buildings in the list of historical and cultural protection areas and historical buildings protection and management.

The protection list shall specify the name, location, completion time and historical value of the protected object, with clear geographical coordinates and corresponding boundary topographic map. The name of the protected object shall not be changed in principle.

The competent department of urban and rural planning of the Municipal People's Government shall establish archives for the protected objects listed in the protection list. The protection list and archives shall be incorporated into the historical and cultural protection information management and inquiry system.

Any unit or individual has the right to inquire about the protection list and archives according to law.
