1. There is no national standard for electric tricycles.
There is no relevant national industry standard for the production of electric tricycles.
There are a large number of over-standard electric bicycles and illegally produced electric (motorized) tricycles on the roads in Shenzhen, which belong to illegally assembled and modified motor vehicles and have no legal qualification.
Moreover, the vehicle attributes of electric tricycles have reached the motor vehicle standards, and the specific standards of motor vehicles should be formulated by the relevant state departments, not in the non-motor vehicle management measures of our city, which will violate the upper-level law.
2. An electric tricycle is a motor vehicle.
According to Articles 8, 19, 95 and 119 of the Road Traffic Safety Law of the People's Republic of China and General Technical Conditions for Electric Bicycles (GB 6B17761-1999).
And Technical Requirements for Motor Vehicle Safety (6B7528—2004), electric tricycles belong to motor vehicles. The Ministry of Public Security clearly stipulates that traffic accidents and illegal acts involving electric tricycles should be treated as motor vehicles.
3. Electric tricycles are not suitable for development in Shenzhen.
90% of roads in Shenzhen have no non-motor vehicle lanes, and most of them are set together with sidewalks, with the highest motor vehicle density in China. If electric tricycles are allowed to pass unrestricted, whether they are driving on sidewalks or motorways, the traffic order in our city will be very chaotic.
At the same time, if the express delivery industry is allowed to use electric tricycles for distribution, it will also have an impact on other distribution industries in our city.
4. Management of electric tricycles in express delivery industry
For the express delivery industry, Shenzhen Traffic Police will continue to support its healthy development in the past, present and future.
Since 20 12, Shenzhen traffic police has kept close contact with industry authorities and associations and has a good communication and coordination mechanism.
In 20 12, the vehicle registration management system for special industries was jointly launched, allowing registered electric bicycles to pass on unrestricted roads, and supporting the healthy and standardized development of Shenzhen express delivery, water supply, gas supply, newspaper delivery, emergency repair and other industries related to people's livelihood.
At the same time, according to the actual needs of the industry, gradually increase the quota. 20 16 Shenzhen traffic police conducted transition management for electric tricycles of express delivery enterprises, and eliminated them after the transition period.
However, the express electric tricycle outside the original special zone is still the main transportation and distribution work of express delivery enterprises, and it has not been replaced as promised.
5. Provisions of Shenzhen Municipality on the Administration of Electric Tricycles
According to the Notice of Shenzhen Public Security Traffic Police Bureau on Restricting the Driving of Electric Bicycles on Some Roads in Our City issued by Shenzhen Traffic Police every six months, "human tricycles, electric tricycles and other second-and third-wheeled non-motor vehicles with power devices are prohibited from passing through our roads".
The illegal use of electric tricycles on the road, temporarily detained vehicles, and impose a fine of 2000 yuan;
The driver who has no corresponding driving qualification and drives a vehicle in driving without a license shall be placed in administrative detention for less than fifteen days.
