Chapter I General Provisions Article 1 In order to strengthen the management of gas, safeguard the safety of people's lives and property, safeguard the legitimate rights and interests of gas users and operators, and promote the development of gas industry, these Regulations are formulated in accordance with the relevant provisions of the state and the province and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to gas planning, gas engineering construction, gas operation and use, management and protection of gas facilities, sales, installation and maintenance of gas appliances and gas safety management within the administrative area of this Municipality. Article 3 The municipal construction administrative department is the administrative department in charge of the city's gas industry (hereinafter referred to as the municipal gas administrative department), and is responsible for the organization and implementation of these Regulations, and its subordinate gas management institutions are responsible for the daily management of gas.

The gas administrative department of the county (city) people's government is responsible for the gas management within its jurisdiction, and accepts the supervision and guidance of the municipal gas administrative department.

Planning, land and resources, public security, production safety supervision, quality and technical supervision, urban management, transportation, environmental protection, industry and commerce, price and other relevant administrative departments shall do a good job in gas management according to their respective responsibilities. Article 4 The municipal and county (city) people's governments shall incorporate the gas industry into the national economic and social development plan, and adhere to the principles of unified planning, supporting construction, safe gas supply, convenience for users, energy conservation and environmental protection. Fifth gas authorities, radio and television, press and publication, education and other relevant administrative departments and gas enterprises should strengthen the publicity and popularization of gas safety knowledge, improve users' safety awareness, and actively prevent all kinds of gas accidents. Chapter II Planning and Construction Article 6 The gas development plan shall be compiled by the municipal, county (city) gas authorities in conjunction with the planning and other relevant administrative departments, incorporated into the overall urban planning, and implemented after being approved in accordance with legal procedures. Seventh new construction, renovation and expansion of gas engineering projects, should be in line with the gas development plan, to perform the basic construction procedures, and by the municipal gas authorities in conjunction with the public security fire and other relevant departments for examination and approval, before construction.

In violation of the provisions of the preceding paragraph of this article, unauthorized construction, shall be ordered to stop the illegal behavior, and impose a fine of 50 thousand yuan to 654.38+10 thousand yuan. Eighth new construction, renovation and expansion projects within the scope of gas development planning, the supporting gas facilities should be designed, constructed and accepted at the same time as the main project.

Projects that have been put into use but have not been equipped with pipeline gas facilities need to use pipeline gas, and the supporting construction of pipeline gas facilities should be carried out in a planned way.

In violation of the provisions of the first paragraph of this article, it shall be ordered to make corrections and impose a fine of 20% to 65% of the cost of gas facilities. Ninth approved pipeline gas project, the pipeline needs to pass through the relevant units or residential buildings, the relevant units and individuals shall cooperate, and shall not obstruct the construction of gas projects.

If the construction unit causes damage to the relevant facilities of relevant units or individuals due to construction, it shall repair or compensate.

In violation of the provisions of the first paragraph of this article, it shall be ordered to make corrections, and the individual shall be fined 100 yuan, and the unit shall be fined 1000 yuan. Tenth gas project is completed, the construction unit shall organize acceptance in accordance with the provisions of relevant laws and regulations. Without acceptance or unqualified acceptance, it shall not be put into use.

The construction unit shall, within 0/5 days from the date of completion and acceptance of the gas project, file with the municipal gas authorities and other relevant departments in accordance with the relevant provisions of the state.

After the completion and acceptance of the gas project, the construction unit shall establish and improve the project archives, and timely hand over the project archives to the urban construction archives management institution or other relevant departments.

In violation of the provisions of the first paragraph of this article, it shall be ordered to stop the illegal act and impose a fine of more than 2% and less than 4% of the contract price of the project. Chapter III Operation and Management Article 11 The establishment of a gas enterprise shall meet the conditions stipulated by the construction administrative department authorized by the State Council, and may engage in gas business activities only after being approved by the construction administrative department of the local city people's government.

The construction administrative department of the municipal people's government where the district is located shall examine the application in accordance with the prescribed conditions, procedures and time limits, and make a decision on whether to grant or not to grant permission according to law.

In violation of the provisions of the first paragraph of this article, it shall be ordered to stop the illegal act, make corrections within a time limit and impose a fine of not less than 50,000 yuan but not more than 654.38 million yuan. Twelfth the establishment of gas distribution stations shall meet the following conditions:

(a) in line with the gas development plan;

(2) Having a fixed business place;

(3) Having two or more professional employees;

(4) Having safety guarantee and after-sales service measures;

(5) Other conditions stipulated by laws and regulations. Thirteenth gas enterprises to set up gas distribution sites, should apply to the municipal gas authorities and provide relevant information, after the municipal gas authorities in conjunction with the public security fire department for examination and approval, can engage in gas distribution business activities.

Temporary service stations that store gas cylinders overnight shall be approved by the municipal gas authorities.

After receiving the application for setting up a gas distribution station, the municipal gas administrative department shall, jointly with the public security fire department, make a decision on whether to approve it within 15 working days.

In violation of the provisions of the first paragraph of this article, those who engage in distribution business activities without examination and approval shall be ordered to stop the illegal behavior, confiscate the illegal income and impose a fine of more than 5,000 yuan/kloc-0,000 yuan.
