How to inherit public housing
Public houses cannot be inherited. The actual user of public houses, that is, the lessee, does not enjoy the property right of public houses, but only enjoys the lease right. If the lessee who meets the lease conditions wants to change the name of the lessee to continue the lease, it can be changed with the consent of the housing management department. In addition, the premise of inheritance is that the decedent had personal legal property before his death, and the property owner of public houses is not an individual, so there is no inheritance problem in public houses.

1. For the lease of public non-residential houses, the parties to the lease shall use the non-residential house lease contract formulated by the Municipal Real Estate Resources Bureau, and the term of the lease contract shall not exceed 20 years. The lessor shall sign a lease contract with the lessee after receiving the relevant deployment documents provided by the lessee.

2. Non-saleable public houses can still be transferred according to the original provisions. Where complete sets of public housing, in addition to historical buildings, party and government organs, scientific research units, institutions of higher learning, etc. are inseparable from office, scientific research, teaching rooms, dangerous houses, houses raised by the government and houses that are not suitable for sale by the municipal government, housing property rights can be sold.

3. In terms of subletting policy of directly-managed public houses, from July 1 day, saleable directly-managed public houses can be rented only after the lessee purchases the property rights. Before July of 1 year, saleable directly-managed public houses have been subletted and the lease contract has been registered and put on record. Property rights can be purchased voluntarily, or the lessee can purchase property rights after the sublease contract expires and then rent them out. With the consent of the management unit of Zhiguangongfang, Zhiguangongfang without purchasing property rights can be subletted to residents who enjoy low-rent housing and economic rental housing rental subsidies.

Article 122 of the Civil Code of People's Republic of China (PRC): Heritage is the personal legal property left by a natural person when he dies. An inheritance that cannot be inherited according to the law or the nature of the inheritance shall not be inherited.
