Twentieth in the scope of protection planning shall not have the following acts:
(a) demolition or construction in violation of the protection plan;
(two) to change the land use function determined by the protection plan;
(three) the breakthrough of building height, floor area ratio and other control indicators, in violation of the requirements of building volume and color;
(four) the destruction of the courtyard layout and hutong texture determined by the protection plan of historical and cultural blocks;
(five) other acts that do not conform to the protection plan.
Article 21 The municipal and relevant district people's governments shall, according to the requirements of protection planning, formulate policies and measures to adjust the urban functions of the old city and relieve the residents of the old city, reduce the population density of the old city and gradually improve the living conditions of the residents of the old city.
Twenty-second Municipal People's Government shall, according to the requirements of protection planning, adjust the road network planning of the old city, and make overall consideration of the needs of various functions such as transportation, municipal facilities, urban landscape and ecological environment.
Article 23 This Municipality encourages the adoption of new materials and technologies, and makes overall plans to improve road traffic, fire-fighting facilities and municipal infrastructure in the old city and historical and cultural blocks in accordance with protection requirements and technical specifications.
Twenty-fourth city planning administrative departments for examination and approval of construction projects in the old city, should be within the scope of the construction project of the existing buildings have protection value, seek the opinions of the municipal administrative department of cultural relics and experts.
Article 25 When planning and approving the construction projects within the historical and cultural blocks, the construction projects within the protection scope of buildings with protection value outside the historical and cultural blocks, the key roads outside the historical and cultural blocks of the old city and the construction projects on both sides thereof, the municipal planning administrative department shall assess the impact of the construction projects on the features of Beijing's historical and cultural cities. Without evaluation, or the evaluation is unqualified, the municipal planning administrative department shall not approve.
The specific scope of key roads shall be delineated and announced by the Municipal People's Government.
Twenty-sixth buildings in historical and cultural blocks shall be protected and renovated in accordance with the following provisions:
(a) immovable cultural relics shall be protected in accordance with the provisions of laws and regulations on the protection of cultural relics;
(two) buildings with protective value shall be protected in accordance with the relevant provisions of these regulations;
(three) other buildings that should be rectified in accordance with the requirements of the protection planning of historical and cultural blocks.
The specific classification standards and requirements for the protection and repair of buildings in historical and cultural blocks shall be formulated and promulgated by the Municipal People's Government.
Article 27 The competent department of city planning administration shall announce to the public the basic information of all kinds of buildings in historical and cultural blocks and buildings with protection value outside historical and cultural blocks.
Twenty-eighth district and county people's governments shall, within 30 days from the date of promulgation by the Municipal People's government, set up protection signs for historical and cultural blocks and buildings with protection value. The standard for setting protection signs shall be uniformly determined by the Municipal People's Government.
No unit or individual may damage or illegally move or remove the protective signs.
Twenty-ninth fire facilities and passages in historical and cultural blocks should be set up in accordance with relevant fire technical standards and norms. Due to the need of protection, the public security fire control institutions and the municipal planning administrative department shall formulate corresponding fire safety measures through consultation.
Thirtieth in the urban landscape line and street landscape protection planning, the construction should meet the requirements of landscape vision, and it is forbidden to build buildings that have an impact on landscape protection.
The height, volume, shape and color of buildings around landscape architecture should be coordinated with landscape architecture.
Thirty-first buildings with protection value shall not be illegally demolished, rebuilt or expanded.
The site selection of construction projects should avoid buildings with protective value; If the public interest is really unavoidable, protective measures such as relocation and off-site protection should be taken for buildings with protective value.
Involving relocation protection in different places, the construction unit shall provide relocation feasibility report, relocation data and other information, which shall be reviewed by the municipal planning administrative department in conjunction with the municipal cultural relics administrative department and reported to the Municipal People's government for approval.
Thirty-second any unit or individual who finds buildings with protection value but not yet determined as protection value in urban construction may put forward protection suggestions to the municipal cultural relics administrative department or the municipal planning administrative department. The municipal cultural relics administrative department shall, jointly with the municipal planning administrative department, make a preliminary confirmation in accordance with the standards and procedures stipulated in Article 14 of these regulations. If it is initially confirmed to have protective value, it shall take temporary protective measures and report to the Municipal People's Government in accordance with the provisions of Article 15 of these regulations.
Article 33 The owners, managers and users of buildings with protection value shall fulfill the obligations of management, maintenance and repair in accordance with the requirements of relevant protection plans and protection and repair standards. Protection and repair standards shall be formulated by the municipal planning administrative department in conjunction with the municipal construction and cultural relics administrative departments.
If the owner, manager and user have an agreement on the maintenance and repair obligations, such agreement shall prevail.
The Municipal People's Government shall take measures to protect buildings whose owners, managers and users do not have the ability to manage, maintain and repair.
Article 34 No unit or individual may illegally change the historical names of buildings, traditional streets and areas with protection value. If it is really necessary to change its name due to special circumstances, the administrative department of place names shall solicit the opinions of the municipal administrative department of cultural relics when examining and approving.
