Regulations of Nanchang Municipality on the Protection of Historical and Cultural Cities
Chapter I General Provisions Article 1 In order to strengthen the protection of historical and cultural cities, inherit excellent historical and cultural heritage and promote coordinated economic and social development, these Regulations are formulated in accordance with the provisions of the Urban and Rural Planning Law of People's Republic of China (PRC) and the Regulations on the Protection of Famous Historical and Cultural Cities, Towns and Villages of the State Council, and in combination with the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, protection, utilization and management of famous historical and cultural cities within the administrative area of this Municipality.

The protection objects of historical and cultural cities mentioned in these Regulations include historical cities, historical and cultural blocks, historical and cultural towns, historical and cultural villages, historical features, historical buildings, traditional villages, cultural relics protection units, immovable cultural relics, ancient and famous trees, historical place names and intangible cultural heritage. Article 3 The protection of historical and cultural cities shall follow the principles of scientific planning, classified management, strict protection and rational utilization, maintain the authenticity and integrity of historical and cultural heritage, and maintain the traditional pattern and historical features. Article 4 The people's governments of cities and counties (districts) shall be responsible for the protection and management of famous historical and cultural cities within their respective administrative areas, and shall incorporate the protection and management of famous historical and cultural cities into the national economic and social development plan. Article 5 The Municipal People's Government shall set up a Committee for the Protection of Historical and Cultural Cities, which shall be responsible for studying major issues concerning the protection of historical and cultural cities, guiding and coordinating the protection of historical and cultural cities.

The Committee for the Protection of Historical and Cultural Cities shall set up an expert committee for the protection of historical and cultural cities (hereinafter referred to as the expert committee). The Committee of Experts is composed of experts in planning, culture (cultural relics), real estate, architecture, gardens, tourism, religion, history, place names, folk customs, laws and traditional crafts, and is responsible for demonstrating and evaluating the protection list, protection planning and protection measures of historical and cultural cities. Sixth urban and rural planning departments in conjunction with the municipal cultural (cultural relics) department is responsible for the protection and management of the city's historical and cultural city; City historical and cultural city protection and management institutions (hereinafter referred to as the municipal management institutions) are responsible for the daily work.

County urban and rural planning departments in conjunction with the cultural (cultural relics) departments at the same level are responsible for the protection and management of historical and cultural towns, villages, historical and cultural blocks, historical features and historical buildings under their jurisdiction.

Real estate, development and reform, construction, urban management, land and resources (real estate registration), finance, public security, tourism, landscaping, forestry, civil affairs, agriculture, water, environmental protection, transportation, education, religion and other departments. Should be within the scope of their respective duties, do a good job in the protection and management of historical and cultural cities. Seventh township (town) people's governments and sub-district offices should do a good job in the protection of historical and cultural cities. Eighth city and county (District) people's government should be the protection of historical and cultural cities, included in the fiscal budget at the corresponding level, earmarking.

Protection funds are used for the census, surveying and mapping, declaration, identification, academic research, professional training, planning, construction and maintenance of protection information systems, improvement of protection facilities and environment, subsidies for protection and repair, publicity and education, protection awards, etc. of historical and cultural cities.

Encourage individuals and units to participate in the protection of historical and cultural cities through donations, investments, the establishment of public welfare organizations, and the provision of technical and voluntary services. Ninth city and county (District) people's governments and urban and rural planning, culture (cultural relics), judicial administration, education and other relevant departments should strengthen publicity and education on the protection of historical and cultural cities, popularize protection knowledge, and enhance citizens' awareness of protection. Chapter II List of Protection Article 10 This Municipality implements the system of the List of Protection of Historical and Cultural Cities (hereinafter referred to as the List of Protection). The following protected objects should be included in the protection list:

(1) Historical and cultural blocks;

(2) Historical sites;

(3) Famous historical and cultural towns, villages and traditional villages;

(four) immovable cultural relics, including cultural relics protection units at all levels;

(5) Historical buildings;

(6) Modern industrial heritage;

(seven) underground cultural relics buried areas and ancient sites;

(8) Historical and environmental factors such as ancient rivers and lakes, ancient and famous trees, ancient bridges, ancient roads and ancient stone carvings;

(9) Intangible cultural heritage such as local traditional literature, traditional performing arts, folk customs and folk traditional crafts;

(ten) old place names with historical and cultural value and commemorative significance;

(eleven) other protected objects determined and announced by the national, provincial and municipal people's governments. Eleventh protection list published by the Municipal People's government.

The protected objects approved and announced by the national, provincial and municipal people's governments are directly included in the protection list; The protected objects approved by the county people's government shall report to the Municipal People's government in a timely manner, and the Municipal People's government shall include them in the protection list.

Historical sites, historical buildings and other protected objects shall be consulted by the competent department of urban and rural planning in conjunction with the departments of culture (cultural relics) and real estate, and reported to the people's government at the same level for approval.

Any individual or unit can put forward suggestions to the city management organization to include cultural relics with protection value in the protection list. Twelfth areas that are not declared as historical and cultural blocks and meet one of the following conditions, with an area of more than one hectare, can be declared as historical scenic spots by the people's governments of cities and counties:

(a) a relatively complete traditional pattern and historical features;

(two) typical, distinctive, can reflect the local characteristics of a certain historical period;

(3) Areas with rich historical and cultural relics.
