Chapter II Management Institutions and Functions
Article 4 The Spark Plan shall be managed at the national, provincial, prefectural and county levels, and work shall be carried out at different levels. The administrative departments of science and technology of governments at all levels should establish and improve the management mechanism of Spark Plan, and have special personnel responsible for its daily work. It is necessary to maintain the relative stability of the management organization and personnel of Spark Plan.
Article 5 The Spark Plan Office of the Ministry of Science and Technology (hereinafter referred to as Spark Office of the Ministry of Science and Technology) is responsible for the centralized management of the Spark Plan, studies and puts forward the macro strategy and policies of the Spark Plan, and organizes the formulation of the medium-and long-term development outline of the National Spark Plan; Release the project guide of spark plan and prepare the annual national spark plan; Guide and coordinate the work of the national spark plan.

The state gives macro guidance to the construction and development of Spark Science and Technology Demonstration Zone, and assists local governments to create environment and conditions for the development of the demonstration zone.
Article 14 The Ministry of Science and Technology will regularly evaluate the Spark Demonstration Zone and Spark Key Enterprises according to relevant measures, and those that pass the evaluation will continue to be supported; Those who fail the exam will be disqualified. The administrative departments of science and technology of all provinces and ministries are responsible for the daily work of environmental construction in their own regions and departments, and coordinate and solve various problems in implementation.
After the completion of all kinds of Spark Science and Technology Demonstration Zone construction tasks, the implementation unit will apply for acceptance, and the Ministry of Science and Technology will organize or entrust provincial and ministerial science and technology departments to organize experts to conduct acceptance.
Article 15 In order to encourage Spark enterprises to rely on scientific and technological progress, improve the scientific and technological content of products and create a number of Spark brand-name products, the Ministry of Science and Technology will grant a number of Spark enterprises the right to use the Spark trademark according to the application of enterprises and the recommendation of the administrative departments of science and technology of provinces and ministries.
Article 16 According to the needs of rural economic development, personnel training should be carried out around popularizing science and technology, disseminating scientific knowledge and improving farmers' quality, and the principle of "practicality, practicality and effectiveness" should be adhered to, so as to cultivate rural technical and management talents and farmers' entrepreneurs and technical experts. The Ministry of Science and Technology will improve the national spark training base system, issue spark training tasks in the form of bidding, and carry out high-level technology, management and teacher training.
Seventeenth to establish the annual work conference system of Spark Plan. Regularly hold the annual work meeting of the Spark Plan, study and determine the key tasks and work measures of the annual Spark Plan, exchange practices and experiences of spark work around the country, and release the project guide of the Spark Plan.
Chapter IV Project Declaration and Implementation
Article 18 The Ministry of Science and Technology organizes and implements a number of national general and key projects of Spark Plan every year according to the overall national policy of national economic and social development in different periods and the tasks put forward by the development outline of Spark Plan.
General projects refer to projects that promote the comprehensive and sustainable development of agriculture and rural economy and promote the transformation and development of scientific and technological achievements in rural areas; Key projects refer to those included in the national spark plan of that year and recommended by the science and technology administrative departments of relevant provinces and ministries around the "Eight Spark Science and Technology Actions", which have a significant impact on the scientific and technological progress of regions or industries and can effectively enhance the scientific and technological innovation capability.
All key projects listed in the national spark plan will be given some guiding financial support.
Nineteenth to declare the national spark plan project must have the basic conditions:
1. conforms to the national industrial and technical policies, the requirements of the national economic and social development strategy and industry development planning in this region, and is conducive to protecting the ecological environment;
2. Advanced and applicable technology, mature and reliable, conducive to the strategic adjustment of agricultural and rural economic structure, with good economic, social and ecological benefits and development prospects;
3. It is conducive to promoting rural scientific and technological progress and improving the quality of rural workers, increasing rural employment opportunities and increasing local fiscal revenue and farmers' income;
4 project reporting units must be enterprises and institutions with independent legal personality, with enterprises as the main body. Encourage enterprises to jointly declare with universities and scientific research units;
5. The project applicant shall have a good financial, commercial and social moral reputation, a good operating mechanism and no intellectual property disputes. Projects applying for bank loans must meet the requirements of bank credit.
In addition to the above conditions, the units applying for key projects must also have strong technical development and application capabilities, reliable technical support and other relevant conditions required to complete the project.
Twentieth general project declaration, approval, implementation management and acceptance procedures:
1. The provincial administrative department of science and technology is responsible for the unified organization and declaration of the general projects of the national spark plan.
2. Any unit that applies for undertaking the national spark plan project must truthfully fill in the declaration form of the spark plan project (see Annex 1), and submit it to the provincial and ministerial level administrative department of science and technology after being audited by the local administrative department of science and technology.
3. The administrative departments of science and technology of provinces and ministries are responsible for the evaluation and demonstration of the national spark plan projects in their respective regions and departments. According to the network management requirements of Spark Plan, the project application materials that have passed the review will be sent to Spark Office of the Ministry of Science and Technology by email before 1 1.30 every year. 4. Twenty-first key projects declaration, approval, implementation management and acceptance procedures:
1. Key projects of the National Spark Plan shall be declared by the administrative departments of science and technology of provinces and ministries.
2. Units that declare key projects must truthfully fill in the Spark Plan Project Declaration, the feasibility study report of the Spark Plan key projects (see Annex 2) and experts' preliminary argumentation opinions and other relevant materials, and submit them to the Spark Office of the Ministry of Science and Technology in ten copies after being audited by the administrative department of science and technology of the province and ministries.
3. The Spark Office of the Ministry of Science and Technology organizes experts to review and identify the application materials openly, fairly and justly, and determine the project undertaker.
4. Within 1 month after the establishment of key projects, the project undertaker shall be organized by the administrative departments of science and technology of provinces and ministries, and sign the task book of science and technology development projects with the Ministry of Science and Technology as required (see Annex 3), and submit it to Spark Office of the Ministry of Science and Technology in six copies.
5. After signing the project task book, the Ministry of Science and Technology and the Ministry of Finance shall, in accordance with the provisions of the financial appropriation system, issue financial support funds for key projects of the National Spark Plan. State financial support funds should be used strictly in accordance with the relevant provisions of the state science and technology funds management, so as to be earmarked and not used for other purposes.

For those who seriously violate the project task book and fail to make corrections within the prescribed time limit, the Ministry of Science and Technology will cancel the project and recover the state financial support funds.
8. The Spark Office of the Ministry of Science and Technology organizes or entrusts the administrative departments of science and technology of provinces and ministries to be responsible for organizing the acceptance of key projects. Key projects should apply for acceptance within 3 months after the completion of the project, and within 1 month after the acceptance, the relevant materials should be reported to the Spark Office of the Ministry of Science and Technology for the record. If the acceptance of key projects is unqualified, the Spark Office of the Ministry of Science and Technology will notify them as appropriate, except for cases caused by irresistible factors.
9 scientific and technological achievements produced in the process of project implementation meet the appraisal conditions, and may apply to the relevant departments for appraisal of achievements.
Twenty-second establish the annual report system of Spark Plan. The administrative departments of science and technology of all provinces and ministries are responsible for compiling the annual report on the implementation of the Spark Plan of their respective regions and departments (see Annex 4 for compilation contents), and submitting it to the Spark Office of the Ministry of Science and Technology before the end of each year 1. The provincial spark planning department should also establish the corresponding spark plan web page to realize the network link and resource sharing of the national spark plan.
Article 25 The administrative departments of science and technology at all levels shall, jointly with relevant departments, regularly commend and reward the collectives and individuals who have made outstanding contributions and made remarkable achievements in the work of Spark Plan.
