According to the website of Beijing Municipal People's Government, on July 1, Beijing Municipal Commission of Housing and Urban-Rural Development, Beijing Municipal Commission of Planning and Natural Resources, beijing municipal commission of development and reform and Beijing Municipal Bureau of Finance jointly issued the Opinions on the Pilot Work of Renovation of Dangerous Old Buildings (hereinafter referred to as the Opinions), clarifying that all district governments in Beijing can demolish and rebuild simple residential buildings and dangerous houses without reinforcement value, and try their best to supplement living facilities such as kitchens and toilets and appropriately increase them.

The "Opinions" are mainly aimed at simple houses such as dangerous houses with poor building structure, disrepair, insufficient infrastructure damage, major security risks, no reinforcement value or reinforcement methods that seriously affect living safety and quality of life.

The transformation of the Opinions will adhere to the principle of "try first", and the pilot projects will be selected and implemented by the district governments, and the relevant municipal departments will give policy support.

At the same time, residents' opinions should be fully solicited in the determination of the implementation subject, the investigation of residents' willingness to rebuild, the formulation of reconstruction design scheme and implementation scheme, and the content of reconstruction agreement. Among them, the renovation intention, renovation design and implementation scheme consultation need to be agreed by not less than two-thirds of the total number of households, and the contents of the renovation agreement need to be agreed by not less than 90% of the residents before the project can be promoted.

During the renovation of dilapidated buildings, residents can voluntarily choose to move back to the original site or move out. Residents voluntarily choose to move back to the original site, and the property rights of the relocated houses are managed according to the property rights of affordable housing. Residents who voluntarily choose to move out can apply for rent withdrawal policy with reference to directly managed public houses. Eligible people can buy * * * property houses or rent public rental houses.

Residents who have lived in the project area for a long time and built their own houses, have Beijing household registration, and have no formal housing for themselves, their spouses and minor children in Beijing, can give priority to renting public rental houses or buying * * * property houses to solve family housing difficulties.

As for the resource source of reconstruction, the Opinions indicated that the "cost * * * burden" model will be adopted to raise funds through multiple channels. Reconstruction funds are raised by the government, property units, residents, social institutions and other subjects, which can be solved by various ways such as government special fund subsidies, property unit investment, residents' investment, sale of public housing, rental and sale of operating supporting facilities.

Specifically, government subsidies are mainly aimed at renovation projects that are included in the scope of comprehensive renovation of old residential areas, and are implemented in accordance with the financial support policy for comprehensive renovation of old residential areas and the subsidy policy for infrastructure renovation.

The Opinions also clarified the scope of residents' investment. Residents who rent public houses and are willing to obtain the property rights after renovation should bear part of the housing renovation costs. Among them, the original area is insufficient, and the cost is not higher than the comprehensive reconstruction cost except the government and property unit subsidies; After renovation, the newly added area shall be no less than the comprehensive renovation cost, or about 70% of the price of ordinary commodity housing with the same quality in the same lot.

Residents who can't afford it due to financial difficulties can continue to rent the rebuilt houses. The original housing area, continue to collect rent in accordance with the standard of public housing rent; For the newly added area after transformation, the rent shall be charged according to the rent standard of public rental housing.

For residents whose original houses are purchased public houses or commercial houses, in addition to subsidies from the government and property units, they should bear the insufficient part of the comprehensive renovation cost of the original housing area. District People's governments, municipal government committees, offices and bureaus, and relevant units:

In order to further deepen the comprehensive transformation of old residential areas and promote the orderly reconstruction of dilapidated houses, with the consent of the municipal government, we hereby put forward the following pilot opinions:

I. Scope of application

This opinion is applicable to simple houses with poor building structure, disrepair, insufficient infrastructure damage and major security risks identified by the municipal and district housing management departments, and dangerous old buildings with no reinforcement value or reinforcement methods that seriously affect the living safety and quality of life identified by professional housing safety testing units. Renovation, reconstruction or appropriate expansion (hereinafter referred to as reconstruction) shall be carried out to eliminate residential risks and security risks and improve public services.

Dangerous and old buildings involving immovable cultural relics, historical and cultural blocks and key areas that cannot be rebuilt in the original site shall be implemented in accordance with relevant regulations.

Central units (including central state organs, troops stationed in Beijing, central enterprises and institutions) shall formulate policies for the renovation of dilapidated buildings separately.

Second, the working principle

The renovation of dilapidated buildings is based on Beijing's overall urban planning and zoning planning, following the basic principles of regional total balance and not increasing the number of households, with the fundamental starting point and end result of eliminating residential dangers and security risks, promoting urban organic renewal and properly improving residents' living conditions. Adhere to the pilot first, the district government chooses pilot projects and organizes their implementation, and relevant municipal departments give policy support.

Third, the pilot content

(1) Organizing the implementation

1. Determine the theme. Reasonable determination of the main body of reconstruction project implementation, determination procedures should be open and transparent, and fully solicit the opinions of residents. Among them: for the renovation project of a single property right unit, the property right unit can be the main body of implementation, or an enterprise with mass work experience, high credit rating and strong organization and implementation ability can be entrusted as the main body of implementation.

For renovation projects with more than two property rights units, the district government shall organize multi-party property rights units to sign agreements on the implementation subject, the right to use state-owned land and other related matters, and determine the implementation subject according to the agreement.

For renovation projects with unclear property rights units, the district government shall determine the implementation subject according to regulations.

2. Ask for advice. The district government organizes the implementers to make a thorough investigation of their intentions, work out planning and design plans and reconstruction implementation plans, and solicit opinions from responsible planners and housing residents. The implementation plan includes the scope, contents, financing methods, resettlement methods, residents' participation in decision-making procedures, project cycle, property management and fees.

3. Approval procedure. All examination and approval procedures for reconstruction projects shall be handled by the corresponding district-level administrative departments. The district government can refer to the requirements of optimizing the business environment policy, further optimize the approval procedures for reconstruction projects, simplify the preconditions for approval, and shorten the approval time.

(2) Planning land policy

1. Land supply mode. The reconstruction project shall go through the construction procedures with reference to the affordable housing project, and the original state-owned land use right shall be fully recovered, supplied to the project implementation subject by re-allocation, and the state-owned construction land use right shall be registered for the first time.

2. Construction scale. According to the intensive use of land resources in the Regulations on Block Control, underground space, vacant space and idle space can be appropriately used to supplement regional operating and non-operating supporting facilities, in which the land for operating supporting facilities is supplied through agreement transfer, and the new supporting facilities are arranged and used by the district government as a whole, and the use purpose cannot be changed.

In principle, compared with the status quo, the number of households does not increase. In order to improve the living conditions of residents, the construction scale can be appropriately increased if conditions permit. After resettlement, the remaining complete houses due to relocation or monetary compensation are repurchased by the district government and can be used as public rental houses or directional resettlement houses.

3. Architectural design. Reconstruction projects shall not reduce the living area of the original residents' houses. Non-complete houses such as simple buildings can appropriately increase the area of residents' kitchens and bathrooms according to the design of complete houses, and focus on solving the problem of improving the use function of buildings.

4. Standards for examination and approval of drawings. Mandatory standards such as foundation and main structure safety, fire protection, building energy conservation, etc. shall be reviewed in principle according to the current residential design standards, and other mandatory standards involving building functions and related supporting facilities shall not be reviewed. The implementer should confirm the relevant contents with the residents and make good contact with the drawing review agency.

(3) Capital policy

1. Cost * * *. Reconstruction funds are raised by the government, property units, residents, social institutions and other subjects, which can be solved by various ways such as government special fund subsidies, property unit investment, residents' investment, sale of public housing, rental and sale of operating supporting facilities.

2. Government subsidies. Renovation projects are included in the scope of comprehensive renovation of old residential areas, and the financial support policy is implemented in accordance with the Letter on Financial Subsidy Policy for Comprehensive Renovation of Old Residential Areas in Urban Areas (Jing Caijing [2065438+09] No.204). The finance of the six districts of the city and Tongzhou district is not higher than 0.2 times of the unit price of 65438+ municipal subsidies, and the finance of the suburbs is not higher than the unit price of municipal subsidies.

The district governments may, according to the actual situation, arrange revolving houses to connect with residents, and give appropriate subsidies during the residents' turnover. Specific standards shall be formulated by the district governments.

3. Subsidies for pipe network transformation. The infrastructure renovation involved in the renovation project is based on the Work Plan for Accelerating the Replacement of Self-prepared Wells and the Renovation of Water Supply Network in Old Residential Areas (Beijing Zhengban [2017] No.31) and the Work Plan for the Renovation of Distribution Network in Old Residential Areas in Beijing (20 18-2022) (Beijing Development Reform [20/]

4. Residents pay fees. Residents should share part of the renovation costs of the renovation project, including:

(1) Residents who have rented public houses and are willing to acquire the property rights of rebuilt houses should bear part of the housing reconstruction expenses. Among them, the original area is insufficient, and the cost is not higher than the comprehensive reconstruction cost except the government and property unit subsidies; After renovation, the newly added area shall be no less than the comprehensive renovation cost, or about 70% of the price of ordinary commodity housing with the same quality in the same lot. Specific standards shall be formulated by the district government.

Residents who can't afford it due to financial difficulties can continue to rent the rebuilt houses. The original housing area, continue to collect rent in accordance with the standard of public housing rent; For the newly added area after reconstruction, the rent shall be charged according to the rent standard of public rental housing, and the specific standard shall be formulated by the district government.

(2) The residents whose original houses are purchased public houses or commercial houses, in addition to subsidies from the government and property units, the insufficient part of the comprehensive renovation cost of the original housing area shall be borne by themselves. The cost of new housing area after renovation should not be lower than the comprehensive renovation cost, or about 70% of the price of ordinary commodity housing in the same location and quality. Specific standards shall be formulated by the district government.

5. Capital contribution by the property right unit. Housing property units should earnestly fulfill the responsibilities of property owners, and the funds collected from selling houses should be used for reconstruction projects.

(d) property registration and property management

1. After the reconstruction of the project is completed, the implementer can apply for the first registration of state-owned construction land use right and house ownership. Single houses, including new construction area, are uniformly registered as "managed according to the property rights of affordable housing". Among them, the original housing has been converted into commercial housing, public houses have been purchased, and comments are made when handling the registration of real estate rights. When the commercial housing is listed and transferred, it is not necessary to pay the land price, but should pay the new area. Public service supporting houses are invested by the government, and the property rights are owned by the district government. After the first registration, the implementation subject shall be handed over to the designated department of the district government free of charge.

2. Property management. Decoration projects should clearly establish standardized property management in the decoration plan. After the completion of the renovation project, the owner shall pay the residential special maintenance funds and property service fees in accordance with the regulations, and the single building can establish property management services in units of buildings.

(five) with the application for rent refund and housing security policy convergence.

1. Apply for rent withdrawal. Incorporated into local reconstruction projects, residents can choose to move back to the original site or move out. Among them, the relocated households refer to the application-based rent-withdrawal policy of the public houses directly under our government. Eligible people can rent public rental housing or buy * * * property houses.

Residents living in regular bungalows participate in the renovation project, and households participate in the project, which can be implemented with reference to the above policies.

2. Housing security. Residents who have lived in their own houses for a long time within the scope of the project, have the household registration in this city, and have no formal housing for themselves, their spouses and minor children in this city, can give priority to renting public rental housing or buying * * * property houses to solve the family housing difficulties.

Fourth, the workflow.

(a) the district government combined with the actual situation in this area, determine the pilot projects, define the main body of implementation, formulate the renovation plan of dilapidated buildings in this area, report it to the office of the Joint Committee for Comprehensive Renovation of Old Residential Areas in the city, and incorporate it into the annual comprehensive renovation plan of old residential areas after examination and approval by the Joint Committee, and make dynamic adjustments.

(II) The district government and street (township) where the project is located shall organize a thorough investigation, consult residents' intentions, ask the district planning and natural resources department about regional planning, and entrust a professional design unit to design the reconstruction project plan.

(III) Publicize the design scheme according to the residents' participation procedure, and the district planning and natural resources department will guide the implementers to conduct technical review of the design scheme, and the implementers will prepare the transformation implementation scheme according to the design scheme recognized by all parties, and report it to the office of the old community comprehensive improvement association.

(four) publicity planning and design plan, reconstruction implementation plan, solicit the opinions of residents, the revised plan shall be announced again according to the opinions of residents.

Negotiation of the transformation intention and scheme shall be subject to the consent of not less than two-thirds of the total number of households before the next step can be carried out.

(five) the implementation of the main body and residents signed a reconstruction agreement, not less than 90% of the residents within the scope of the reconstruction project agreed to sign a reconstruction agreement, the agreement can take effect, after the agreement takes effect, residents will begin to move. If the contract ratio cannot be reached, the renovation project will be automatically terminated.

(6) District development and reform, natural resources planning, and housing construction departments should optimize and simplify the examination and approval procedures, and handle the necessary procedures such as project initiation, construction project planning permission, commencement, completion filing, and real estate registration according to the reconstruction project construction procedures in this district.

(1) Consolidate the data foundation. The district governments should conduct a thorough investigation on the current situation of simple buildings and dilapidated buildings without reinforcement value in this district, analyze the current situation of houses, and select pilot buildings or areas in combination with existing laws and regulations and requirements for style protection.

(2) Clear specific responsibilities. The relevant departments of the city should designate a person to be responsible according to the division of business, and timely study the problems encountered in the pilot. According to the actual situation, the district governments improve the organizational structure and clarify the division of responsibilities. Encourage grassroots to innovate boldly and create experiences that can be replicated and popularized.

(3) Strengthen public participation. Planning, design and reconstruction implementation plan should solicit opinions from residents extensively, make full use of public platforms, increase publicity, improve transparency of work and residents' participation, and solve problems in reconstruction through * * * governance and autonomy mechanisms according to law.

(4) Strict fund management. Reconstruction project funds shall be co-ordinated at the district level, specially managed and earmarked, and the collection, disbursement, use and management of funds shall be subject to audit supervision by audit institutions according to law.

(5) Strengthening the guarantee of the rule of law. The relevant departments of the municipal and district governments should strengthen overall planning, ensure the orderly implementation of projects according to law, ensure that the wishes of the vast majority of residents can be realized, and ensure safety.

(6) Innovative working methods. The district government shall formulate detailed rules according to the actual situation in this district, and give priority to the pilot work from the buildings with the largest dangerous buildings and the most urgent masses, and do not engage in bonsai projects.
